The Rapporteur strongly believes that the proposed regulation should serve as a genuine instrument of simplification that improves access to funding for end beneficiaries. In the light of major structural challenges such as market volatility, geopolitical instability, climate change, usage conflicts and unfair competition, it is paramount that the regulation helps fisheries to become more competitive and improves the way in which funding is taken up, used and monitored, without creating additional administrative burdens.

The Rapporteur is adamant that the proposal should under no circumstances make life more complex or burdensome for fisheries operators, including with regard to eligibility criteria. After all, the sector is already heavily regulated by the common fisheries policy and sector-specific provisions under the multiannual financial framework. Performance should remain a results-based driver of operational efficiency, as opposed to yet another constraint that is far removed from the realities of people’s lives.

Furthermore, the Rapporteur believes that Parliament should play its full part as co-legislator once again. Given the importance of this regulation, all references to delegated acts or guidance should be removed. Consensus between Parliament and the Council should be sought if any changes are to be made to the legislation.

In the interests of simplification and clarity, and in line with the recommendations of the European Court of Auditors, the Rapporteur strongly believes that the annex should be closely aligned with the actual regulation in order to prevent differing interpretations and ensure that the legislation is implemented consistently by the beneficiaries. In that context, she stresses that the dual priorities of climate action and environmental objectives should be clearly and cogently reflected in the performance framework provisions and annex. This should be done by merging climate change mitigation, adaptation and resilience under a single column on climate action in order to provide greater clarity and simplicity for beneficiaries.

The Rapporteur believes that it would be legitimate to exempt fisheries from the do no significant harm principle. As it is, applying the principle would deliver no added value for the environment, as the common fisheries policy already provides a comprehensive and rigorous framework for fisheries activities; the climate action and environmental objectives principles are quite enough.

The Rapporteur also believes that the gender equality requirement should be applied in a commensurate manner and tailored to the specific features of each sector. This would include fisheries, which is already facing rather pressing challenges around generational renewal and attracting new workers. Gender equality should not be used as a pretext to exclude projects that satisfy every other criterion, including environmental and social criteria.

Finally, the Rapporteur believes that it is essential to put competitiveness back at the forefront of the performance framework. In the light of the Draghi and Letta reports, it would appear essential to incorporate competitiveness monitoring as a horizontal principle across all multiannual financial framework funds in order to bolster the Union’s economic resilience and support sectors of strategic interest in an increasingly competitive global context. The EU’s security and food sovereignty are at stake here, and should therefore be treated as strategic priorities akin to defence or energy.

(1) This Regulation aims to lay down the elements for both an expenditure tracking and a performance framework applicable to the implementation of expenditure appropriate to each method of implementation and complementing the rules of Regulation (EU, Euratom) 2024/2509 of the European Parliament and of the Council3 on the financial rules applicable to the general budget of the Union (the ‘budget’) as part of the financial rules within the meaning of Article 322(1), point (a), of the Treaty on the Functioning of the European Union (TFEU). In particular, rules should be established on monitoring of budget spending, on monitoring and reporting on the performance of Union programmes and activities, as well as rules on evaluation of the programmes and activities. This Regulation also aims to set out common rules to ensure a uniform application of the ‘do no significant harm’ and gender equality principles; as well as other common rules applicable across the budget such as those for establishing a Single Gateway, and rules on information, communication and visibility. (4a) A horizontal principle to monitor the integration of competitiveness should be established in order to strengthen the competitiveness of the Union and measure how Union funding contributes effectively to that end. Where feasible and appropriate in accordance with the applicable sector-specific rules, Union-funded programmes and activities should be subject to such monitoring with a view to supporting the internal market, digitalisation, SMEs and industrial ecosystems, connectivity, research and innovation, and skills and productivity, and to reducing strategic dependencies, including food security. The coefficients set out in the Annex should therefore be reviewed on a regular basis to ensure that they accurately reflect the actual impact of different actions on competitiveness.

(5) The streamlined application of the ‘do no significant harm’ principle where feasible and appropriate, as referred to in Article 33(2), point (d) of Regulation (EU, Euratom) 2024/2509 should be based on a single and simple guidance. The Commission should provide this technical guidance by 1 January 2027. That guidance should be based on the overarching principles of clarity, simplification and proportionality, having regard to the principles of economy, efficiency and effectiveness and to achieving the set objectives of the programme or instrument in line with the Union’s policy priorities. It should take into due consideration the high levels of protection to human health and the environment provided by existing EU legislation, and the need to avoid duplication with those requirements.(5) Where feasible and appropriate in accordance with the relevant sector specific rules, the streamlined application of the ‘do no significant harm’ principle, is facilitated by this Regulation. Regarding fishing and aquaculture activities, the relevant sector specific rule is Regulation (EU) …/… [establishing the conditions for the implementation of Union support to the Common Fisheries Policy, to the European Ocean Pact and of the Union’s maritime and aquaculture policy as part of the National and Regional Partnership Fund for the period 2028–2034], which lays down requirements for eligibility.

(6) As the economic, financial and societal costs linked to climate change and environmental degradation are growing, it is crucial to invest in decarbonisation, climate resilience, circular economy, water resilience and the natural environment. It is in particular essential to enhance the Union’s and Member States’ capability to anticipate, prepare for, and respond to crises, disasters and impacts of climate change and extreme weather events, and to protect the investments under the EU budget. Deploying new innovative technologies and solutions boosting climate resilience will at the same time increase the competitive edge of the EU companies not only through their improved adaptive capacity and climate resilience but also due to new export opportunities.(6) As the economic, financial and societal costs linked to climate change and environmental degradation are growing, it is crucial to invest in decarbonisation, energy efficiency, climate resilience, circular economy, blue economy, water resilience, food security in the areas of agriculture, fisheries and aquaculture, water and marine pollution reduction and prevention, and the protection of the natural environment. It is in particular essential to enhance the Union’s and Member States’ capability to anticipate, prepare for, and respond to crises, disasters and impacts of climate change and extreme weather events, and to protect the investments under the EU budget. Deploying new innovative technologies and solutions boosting climate resilience will at the same time increase the competitive edge of the EU companies not only through their improved adaptive capacity and climate resilience but also due to new export opportunities. Regarding fisheries and aquaculture sectors, a level playing field shall be maintained between operators from Member States and operators from third countries that sell products on the internal market.

(8) In line with Article 8 TFEU, the Union shall in all its activities aim to eliminate inequalities, and to promote equality, between men and women. Article 33(2), point (e), of Regulation (EU, Euratom) 2024/2509 therefore lays down the requirement for the implementation of programmes and activities to take into account the principle of gender equality in accordance with an appropriate gender mainstreaming methodology, where feasible and appropriate. This Regulation should therefore establish a single set of rules to implement the principle of gender equality consistently. In particular, this Regulation should set out the gender mainstreaming methodology, building on the methodology developed by the Commission under the 2021-2027 MFF and used for the first time for the financial year 2021, to measure expenditure contributing to gender equality through a system of scores based on the objectives pursued by activities supported under Union programmes. Further guidance should be provided by the Commission to ensure the consistent application of that principle. This Regulation should also specify which data collected in relation to performance indicators should be broken down, where feasible and appropriate, by gender.(8) In line with Article 8 TFEU, the Union shall in all its activities aim to eliminate inequalities, and to promote equality, between men and women. Article 33(2), point (e), of Regulation (EU, Euratom) 2024/2509 therefore lays down the requirement for the implementation of programmes and activities to take into account the principle of gender equality in accordance with an appropriate gender mainstreaming methodology, where feasible and appropriate in accordance with the applicable sector-specific rules. (11a) In light of the Union’s ambitious and comprehensive strategy to better protect and restore the ocean, promote a thriving blue economy, and support the sustainable development of people living in coastal areas, as set out in the European Ocean Pact, the European Industrial Maritime Strategy, the European Port Strategy, the EU Coastal Communities Development and Resilience Strategy, the EU Strategy for Outermost Regions and the Strategy for EU Islands, Member States should support the global value chain of fisheries and aquaculture activities.

(12) The economic, financial and social costs linked to climate change, natural hazards, health emergencies, technological accidents, evolving security threats, and other disruptions are growing. It is essential to enhance the Union’s and Member States’ capability to anticipate, prepare for, and respond to crises disasters, and impacts of climate change, to protect the investments under the EU budget, as well as to reinforce internal security. Therefore, preparedness and climate resilience by design should ensure that relevant programmes and activities support reforms and investments that strengthen disaster risk and crises management, invest in climate resilience, enhance the resilience of vital societal functions, and build a more resilient, secure, and prepared societies, in line with the objectives of the EU Preparedness Union Strategy,7 the ProtectEU Strategy8 and the EU obligation under Article 5 of Regulation (EU) 2021/11199 (the ‘European Climate Law’) to reduce vulnerability to climate change.(12) The economic, financial environmental and social costs linked to climate change, natural hazards, health emergencies, technological accidents, evolving security threats, dependency on imported fossil fuels and other disruptions are growing. It is essential to enhance the Union’s and Member States’ capability to anticipate, prepare for, and respond to crises disasters, and impacts of climate change, to protect the investments under the EU budget, as well as to reinforce internal security, food security and sovereignty, by supporting vital supply from the agriculture and fishing sectors. Therefore, preparedness and climate resilience by design should ensure that relevant programmes and activities support reforms and investments that strengthen disaster risk preparedness and crises management capacities, invest in climate resilience, strengthen food self-sufficiency and food sovereignty by supporting fisheries and agriculture, local and resilient food systems, enhance the resilience of vital societal functions, and build a more resilient, secure, and prepared societies. in line with the objectives of the EU Preparedness Union Strategy,7 the ProtectEU Strategy8 and the EU obligation under Article 5 of Regulation (EU) 2021/11199 (the ‘European Climate Law’) to reduce vulnerability to climate change.

(12a) In accordance with Articles 174 and 349 TFEU, this Regulation takes into account the specific constraints of remote, rural, coastal, island, outermost, mountain and sparsely populated regions. This Regulation should provide for these specific circumstances to be integrated into the design and evaluation of performance indicators and for the regional and local authorities concerned to be involved in the relevant tracking and reporting mechanisms, in order to ensure that EU funds are used more effectively and fairly in these areas.

(15) Regulation (EU, Euratom) 2024/2509 refers to the need to track the Union budget spending contributing to gender equality, as well as spending on climate change mitigation and adaptation and on the protection of biodiversity. Expenditures contributing to climate mitigation, climate change adaptation, and biodiversity also need to be tracked to meet the reporting requirements of the United Nations Framework Convention on Climate Change and the Convention on Biological Diversity. A standardised system for classifying activities funded under the budget, which should facilitate the tracking of policies and the aggregation of the contribution from each activity or programme more efficiently, should be put in place.(15) Regulation (EU, Euratom) 2024/2509 refers to the need to track the Union budget spending contributing to gender equality, as well as spending on climate change mitigation, climate adaptation and resilience, and environment, including biodiversity. Expenditures contributing to climate and environmental objectives also need to be tracked to meet the reporting requirements of the United Nations Framework Convention on Climate Change and the Convention on Biological Diversity.

(16) The Commission has established EU climate coefficients to quantify the Union budget expenditure contributing to climate objectives and reflecting the objectives of the European Green Deal. Under that system10 , a coefficient of 100 % is assigned to activities expected to make a substantial contribution to climate change mitigation or adaptation objectives in line with Union climate goals, a coefficient of 40 % is assigned to activities expected to make a non-marginal, positive contribution to climate change mitigation or adaptation objectives, and a coefficient of 0 % is assigned to activities expected to have a neutral impact on climate objectives. For a number of activities, EU climate coefficients reflect the technical screening criteria of the EU Taxonomy of sustainable activities.(16) The Commission has established EU climate coefficients to quantify the Union budget expenditure contributing to climate objectives and reflecting the objectives of the European Green Deal. Under that system10 , a coefficient of 100 % is assigned to activities expected to make a substantial contribution to climate change mitigation or adaptation objectives in line with Union climate goals, a coefficient of 40 % is assigned to activities expected to make a non-marginal, positive contribution to climate change mitigation or adaptation objectives, and a coefficient of 0 % is assigned to activities expected to have a neutral impact on climate objectives.

(24a) In order to ensure sound financial management and transparency in the use of Union funds, the monitoring and reporting framework established under this Regulation shall enable the systematic tracking and evaluation of progress towards the achievement of Union sectoral policy objectives, including those established under the Common Fisheries Policy as set out in Regulation (EU) No 1380/2013.

(25) The power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of: amending the list of intervention fields and performance indicators set out in Annex I to this Regulation; amending the codes for the territorial dimension in Annex II; amending the specific climate and environment spending targets in Annex III; amending the list of programmes relevant for gender equality in Annex IV to this Regulation; amending Annex V to this Regulation on information, communication and visibility; and amending the provision on the Single Gateway as needed. It is of particular importance that the Commission carry out appropriate consultations during its preparatory work, including at expert level, and that those consultations be conducted in accordance with the principles laid down in the Interinstitutional Agreement on Better Law-Making of 13 April 201611 . In particular, to ensure equal participation in the preparation of delegated acts, the European Parliament and the Council receive all documents at the same time as Member States’ experts, and their experts systematically have access to meetings of Commission expert groups dealing with the preparation of delegated acts.(25) The power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of amending the provision on the Single Gateway as needed. 2. This Regulation also establishes rules for ensuring a uniform application of the principles of ‘do no significant harm’ and gender equality referred to in Article 33(2), points (d) and (f) of Regulation (EU, Euratom) 2024/2509 respectively, where feasible and appropriate, in line with the principles of economy, efficiency and effectiveness as set out in Article 33(1) of that Regulation, as well as other horizontal principles regarding working and employment conditions and climate and biodiversity. It also establishes horizontal provisions applicable to all Union programmes and activities, such as rules for establishing a Single Gateway referred to in Article 12 of this Regulation, and rules on information, communication and visibility.2. This Regulation also establishes rules for ensuring a uniform application of the horizontal principles referred to in Article 33(2) of Regulation (EU, Euratom) 2024/2509, where feasible and appropriate in accordance with sector-specific rules, in line with the principles of economy, efficiency and effectiveness as set out in Article 33(1) of that Regulation. It also lays down horizontal provisions applicable to all Union programmes and activities, such as rules for establishing a Single Gateway referred to in Article 12 of this Regulation, and rules on information, communication and visibility. All these principles, provisions and targets shall also contribute to tracking and performance purposes and shall be consistent with eligibility, allocation, implementation, selection or payment conditions for support to fisheries, aquaculture, aquatic food processing, first sale or marketing activities as laid down in the relevant sector-specific Union law. 1. Programmes and activities shall be subject to a competitiveness mainstreaming check to determine their contribution to important Union objectives, such as the strengthening the Single Market, digitalisation, supporting SMEs and industrial ecosystems, addressing missing links in terms of connectivity, supporting innovation and research, improving skills and productivity and reducing strategic dependencies, including food security.
2. Where feasible and appropriate in accordance with the relevant sector-specific rules the contribution from the budget to competitiveness mainstreaming within the Union shall be monitored by means of the budget expenditure tracking and performance framework laid down in Article 8, including by means of EU coefficients.
3. Programmes and activities shall be implemented with a view to contribute to the Unions overall competitiveness objectives over the entire 2028-2034 multiannual financial framework. Such contributions shall be calculated by using the highest coefficient amongst competitiveness mainstreaming check of the framework referred to in paragraph 2.
4. For the purposes of this Article, activities undertaken within different interventions shall be planned and implemented in a coordinated manner, taking into account related actions at Union level, so as to avoid duplication and maximise their contribution to competitiveness.
5. In order to ensure a harmonised application of this principle, the Commission shall assist Member States specifying how actions within specific interventions can contribute to improving competitiveness in the Union and on how to ensure synergies between different activities and interventions.
6. The activities referred to in this Article shall be defined by reference to the list of intervention fields set out in Annex I.
7. By 30 June 2031, the Commission shall report to Parliament and Council on the progress achieved in the competitiveness mainstreaming at Union level. Based on this report the Commission may present a proposal to set a competitiveness spending target for the remaining period of the 2028-2034 multiannual financial framework, if needed.
Failure to meet this objective shall have no bearing on the funding allocated to measures or activities.
