Annex I – paragraph 1 a (new)

Allocation method for the less developed regions
1. Each Member State's allocation shall be the sum of the allocations for its individual eligible regions, calculated in accordance with the following steps:
(a) determination of an absolute amount per year (in EUR) obtained by multiplying the population of the region concerned by the difference between that region's GDP per capita, measured in PPS, and the EU-27 average GDP per capita (in PPS);
(b) application of a percentage to the above absolute amount in order to determine that region's financial envelope; this percentage shall be graduated to reflect the relative prosperity, measured in PPS, as compared to the EU-27 average, of the Member State in which the eligible region is situated, i.e.: (i) for regions in Member States whose level of GNI per capita is below 82 % of the EU-27 average: 2,85 %; (ii) for regions in Member States whose level of GNI per capita is between 82 % and 99 % of the EU-27 average: 1,25 %; (iii) for regions in Member States whose level of GNI per capita is over 99 % of the EU-27 average: 0,75 %;
(c) to the amount obtained in accordance with point (b) is added, if applicable, an amount resulting from the allocation of a premium of EUR 570 per unemployed person per year, applied to the number of persons unemployed in that region exceeding the number that would be unemployed if the average unemployment rate of all the less developed regions applied;
(d) to the amount obtained in accordance with point (c) is added, if applicable, an amount resulting from the allocation of a premium of EUR 570 per young unemployed person (age group 15-24) per year, applied to the number of young persons unemployed in that region exceeding the number that would be unemployed if the average youth unemployment rate of all less developed regions applied;
(e) to the amount obtained in accordance with point (d) is added, if applicable, an amount resulting from the allocation of a premium of EUR 270 per person (age group 25-64) per year, applied to the number of persons in that region that would need to be subtracted in order to reach the average level of low education rate (less than primary, primary and lower secondary education) of all less developed regions;
(f) to the amount obtained in accordance with point (e) is added, if applicable, an amount of EUR 1 per tonne of CO2 equivalent per year applied to the population share of the region of the number of tonnes of CO2 equivalent by which the Member State exceeds the target of greenhouse gas emissions outside the emissions trading scheme set for 2030 as proposed by the Commission in 2016;
(g) to the amount obtained in accordance with point (f) is added, an amount resulting from the allocation of a premium of EUR 405 per person per year, applied to the population share of the regions of net migration from outside the Union to the Member State since 1 January 2014.

Allocation method for transition regions
2. Each Member State's allocation shall be the sum of the allocations for its individual eligible regions, calculated in accordance with the following steps:
(a) determination of the minimum and maximum theoretical aid intensity for each eligible transition region. The minimum level of support is determined by the initial average per capita aid intensity of all more developed regions, i.e. EUR 15,2 per head and per year. The maximum level of support refers to a theoretical region with a GDP per head of 75 % of the EU-27 average and is calculated using the method defined in points (a) and (b) of paragraph 1. Of the amount obtained by this method, 60 % is taken into account;
(b) calculation of initial regional allocations, taking into account regional GDP per capita (in PPS) through a linear interpolation of the region's relative GDP per capita compared to EU-27;
(c) to the amount obtained in accordance with point (b) is added, if applicable, an amount resulting from the allocation of a premium of EUR 560 per unemployed person per year, applied to the number of persons unemployed in that region exceeding the number that would be unemployed if the average unemployment rate of all the less developed regions applied;
(d) to the amount obtained in accordance with point (c) is added, if applicable, an amount resulting from the allocation of a premium of EUR 560 per young unemployed person (aged 15 to 24) per year, applied to the number of young persons unemployed in that region exceeding the number that would be unemployed if the average youth unemployment rate of all less developed regions applied;
(e) to the amount obtained in accordance with point (d) is added, if applicable, an amount resulting from the allocation of a premium of EUR 250 per person (aged 25 to 64) per year, applied to the number of persons in that region that would need to be subtracted in order to reach the average level of low education rate (less than primary, primary and lower secondary education) of all less developed regions;
(f) to the amount obtained in accordance with point (e) is added, if applicable, an amount of EUR 1 per tonne of CO2 equivalent per year applied to the population share of the region of the number of tonnes of CO2 equivalent by which the Member State exceeds the target of greenhouse gas emissions outside the emissions trading scheme set for 2030 as proposed by the Commission in 2016;
(g) to the amount obtained in accordance with point (f) is added, an amount resulting from the allocation of a premium of EUR 405 per person per year, applied to the population share of the region of net migration from outside the Union to the Member State since 1 January 2014.

3. The total initial theoretical financial envelope shall be obtained by multiplying an aid intensity per head and per year of EUR 15,2 by the eligible population.
4. The share of each Member State concerned shall be the sum of the shares of its eligible regions, which are determined on the basis of the following criteria, weighted as indicated:
(a) total regional population (weighting 20 %);
(b) number of unemployed people in NUTS level 2 regions with an unemployment rate above the average of all more developed regions (weighting 12,5 %);
(c) employment to be added to reach the average employment rate (aged 20 to 64) of all more developed regions (weighting 20 %);
(d) number of persons aged 30 to 34 with tertiary educational attainment to be added to reach the average tertiary educational attainment rate (aged 30 to 34) of all more developed regions (weighting 22,5 %);
(e) number of early leavers from education and training (aged 18 to 24) to be subtracted to reach the average rate of early leavers from education and training (aged 18 to 24) of all more developed regions (weighting 15 %);
(f) difference between the observed GDP of the region (measured in PPS), and the theoretical regional GDP if the region were to have the same GDP per head as the most prosperous NUTS level 2 region (weighting 7,5 %);
(g) population of NUTS level 3 regions with a population density below 12,5 inhabitants/km2 (weighting 2,5 %).
5. To the amounts by NUTS level 2 region obtained in accordance with point (4) is added, if applicable, an amount of EUR 1 per tonne of CO2 equivalent per year applied to the population share of the region of the number of tonnes of CO2 equivalent by which the Member State exceeds the target of greenhouse gas emissions outside the emissions trading scheme set for 2030 as proposed by the Commission in 2016.
6. To the amounts by NUTS level 2 region obtained in accordance with point (5) is added, an amount resulting from the allocation of a premium of EUR 405 per person per year, applied to the population share of the region of net migration from outside the Union to the Member State since 1 January 2014.

Allocation method for the Member States eligible for the Cohesion Fund
7. The financial envelope shall be obtained by multiplying the average aid intensity per head and per year of EUR 62,9 by the eligible population. Each eligible Member State's allocation of this theoretical financial envelope corresponds to a percentage based on its population, surface area and national prosperity, and shall be obtained by applying the following steps:
(a) calculation of the arithmetical average of that Member State's population and surface area shares of the total population and surface area of all the eligible Member States. If, however, a Member State's share of total population exceeds its share of total surface area by a factor of five or more, reflecting an extremely high population density, only the share of total population shall be used for this step;
(b) adjustment of the percentage figures so obtained by a coefficient representing one third of the percentage by which that Member State's GNI per capita (in PPS) for the 2015-2017 period exceeds or falls below the average GNI per capita of all the eligible Member States (average expressed as 100 %).
For each eligible Member State, the share of the Cohesion Fund shall not be higher than one third of the total allocation minus the allocation for the European territorial cooperation goal (Interreg) after the application of paragraphs 10 to 16. This adjustment shall proportionally increase all other transfers resulting from paragraphs 1 to 6.

Allocation method for the European territorial cooperation goal (Interreg)
8. The allocation of resources by Member State, covering cross-border, transnational and outermost regions' cooperation is determined as the weighted sum of the shares determined on the basis of the following criteria, weighted as indicated:
(a) total population of all NUTS level 3 border regions and of other NUTS level 3 regions of which at least half of the regional population lives within 25 kilometres of the border (weighting 45,8 %);
(b) population living within 25 kilometres of the borders (weighting 30,5 %);
(c) total population of the Member States (weighting 20 %);
(d) total population of outermost regions (weighting 3,7 %).
The share of the cross-border strand corresponds to the sum of the weights of criteria (a) and (b). The share of the transnational strand corresponds to the weight of criterion (c). The share of the outermost regions' cooperation corresponds to the weight of criterion (d).

— geographical data on country borders (Eurostat GIS database) and the number of visa applications for short stays.

Allocation method for the additional funding for the outermost regions identified in Article 349 TFEU and the NUTS level 2 regions fulfilling the criteria laid down in Article 2 of Protocol No 6 to the 1994 Act of Accession
9. An additional special allocation corresponding to an aid intensity of EUR 40 per inhabitant per year shall be allocated to the outermost NUTS level 2 regions and the northern sparsely populated NUTS level 2 regions. That allocation will be distributed per region and Member State in a manner proportional to the total population of those regions. Minimum and maximum levels of transfers from the funds supporting economic, social and territorial cohesion
10. In order to contribute to achieving adequate concentration of cohesion funding on the least developed regions and Member States and to the reduction of disparities in average per capita aid intensities, the maximum level of transfer (capping) from the Funds to each individual Member State shall be determined as a percentage of the GDP of the Member State, whereby these percentages will be as follows:
(a) for Member States whose average GNI per capita (in PPS) for the 2015-2017 period is under 55 % of the EU-27 average per capita: 2,3 % of their GDP;
(b) for Member States whose average GNI per capita (in PPS) for the 2015-2017 period is equal to or above 68 % of the EU-27 average per capita: 1,5 % of their GDP;
(c) for Member States whose average GNI per capita (in PPS) for the 2015-2017 period is equal to or above 55 % and below 68 % of the EU-27 average per capita: the percentage is obtained through a linear interpolation between 2,3 % and 1,5 % of their GDP leading to a proportional reduction of the capping percentage in line with the increase in prosperity. The capping shall be applied on an annual basis to the GDP projections of the Commission, and shall - if applicable - proportionally reduce all transfers (except for the more developed regions and European territorial cooperation goal (Interreg)) to the Member State concerned in order to obtain the maximum level of transfer.
11. The rules described in paragraph 10 shall not result in allocations per Member State higher than 107 % of their level in real terms for the 2014-2020 programming period. That adjustment shall be applied proportionately to all transfers (except for the European territorial cooperation goal (Interreg)) to the Member State concerned in order to obtain the maximum level of transfer.
12. The minimum total allocation from the Funds for a Member State shall correspond to 76 % of its individual 2014-2020 total allocation. The minimum total allocation from the Funds for a Member State where at least one third of the population lives in NUTS level 2 regions with a GDP per capita (in PPS) of less than 50 % of the EU-27 average, shall correspond to 85 % of its individual 2014-2020 total allocation. The adjustments needed to fulfil this requirement shall be applied proportionally to the allocations from the Funds, excluding the allocations under the European territorial cooperation goal (Interreg).
13. The maximum total allocation from the Funds for a Member State having a GNI per capita (in PPS) of at least 120 % of the EU-27 average shall correspond to 80 % of its individual 2014-2020 total allocation. The maximum total allocation from the funds for a Member State having a GNI per capita (in PPS) equal to or above 110 % and below 120 % of the EU-27 average shall correspond to 90 % of its individual 2014-2020 total allocation. The adjustments needed to fulfil this requirement shall be applied proportionally to the allocations from the Funds, excluding the allocation under the European territorial cooperation goal (Interreg). If a Member State has transition regions for which paragraph 16 applies, 25 % of that Member State's allocation for the more developed regions shall be transferred to the allocation of that Member State's transition regions.

To that end, indicators that complement GDP per capita shall also be taken into account, including disposable household income, the level of poverty and social exclusion, unemployment, maturation, depopulation, low population density, access to basic public services and inter-regional inequalities.

The amount allocated to each outermost region under the National and Regional Partnership Plans shall not be lower, in real terms, than the total allocation that the same region received under the 2021–2027 programming period from the European Regional Development Fund, the European Social Fund Plus and the Cohesion Fund under shared management. Where necessary, the Member State concerned shall adjust the internal distribution of resources within the envelope allocated to its regions to ensure compliance with this requirement.

The allocation of resources by Member State in the Interreg Plan, covering cross-border, transnational and outermost regions' cooperation is determined as the weighted sum of the shares determined on the basis of the following criteria, weighted as indicated:
(a) total population of all NUTS level 3 border regions and of other NUTS level 3 regions of which at least half of the regional population lives within 25 kilometers of the border (weighting 45,8 %);
(b) population living within 25 kilometers of the borders (weighting 30,5 %);
(c) total population of the Member States (weighting 20 %);
(d) total population of outermost regions (weighting 3,7 %).

Justification

The subsidiarity and proportionality principle needs to be upheld. The fund must not become an instrument for the European Commission to infringe on Member States competences to set out national policies in other areas and the possibility to adapt these national policies to the circumstances that may arise. The latter would become increasingly difficult and hamper the Member States flexibility to adapt national policies when these have become interlinked to the NRP plan.

Assessment guidelines for the NRP plans
1. Scope
The purpose of this Annex is to serve together with this Regulation as a basis for the Commission to assess - in a transparent and equitable manner - the NRP plans proposed by Member States and to determine the financial contribution in conformity with the objectives and any other relevant requirements laid down in this Regulation.
In particular, it serves as a tool to:
(a) give further guidance on the assessment process of the proposals for NRP plans submitted by Member States;
(b) provide further details on the assessment criteria and provide for a rating system to be established with a view to ensuring an equitable and transparent process; and
(c) define the link between the assessment to be made by the Commission under the assessment criteria.
2. Assessment criteria
In accordance with Article 22a, the Commission shall assess the NRP plans and shall give ratings under the following eligibility criteria referred to in Article 22:
2.1. The Plan is expected to contribute to effectively addressing a significant subset of the relevant challenges identified in the relevant country-specific recommendations addressed to the Member State concerned or challenges identified in other relevant documents officially adopted by the Commission in the context of the European Semester.
The Plan is expected to effectively implement in the context of the European Semester, a significant subset of relevant country-specific recommendations addressed to the Member State that are relevant for investments and reforms under the Plans objectives, in a manner that holistically and comprehensively contribute to solving the respective and relevant key challenges identified in the Semester report, in particular those relevant to climate, energy and the European Pillar of Social Right.
The Commission shall take into account the following elements for the assessment under this criterion:
Scope
— the Plan is expected to contribute to effectively addressing a significant subset of challenges identified in the relevant country-specific recommendations, addressed to the Member State concerned or challenges identified in other relevant documents officially adopted by the Commission in the context of the European Semester, taking into account the financial contribution of the Member State concerned and the requested loan support as well as the scope and scale of country-specific challenges and the information included in the European Semester; and
— the Plan represents a comprehensive and adequate response to the economic and social situation of the Member State concerned; and
— the challenges addressed by Plan are considered as significant to boost the growth potential of the economy of the Member State concerned in a sustainable manner; and
— following the completion of the proposed reforms and investments, the related challenges would be expected to have been resolved or addressed in a manner that significantly contributes to their resolution.
Rating
A – the Plan contributes to effectively addressing and solving a significant subset of relevant challenges identified in the country-specific recommendations, or challenges in other relevant documents officially adopted by the Commission under the European Semester, and the recovery and resilience plan represents an adequate response to the economic and social situation of the Member State concerned
B – the Plan contributes to partially addressing and solving a significant subset of relevant challenges identified in the country-specific recommendations, or challenges in other relevant documents officially adopted by the Commission under the European Semester and the recovery and resilience plan represents an adequate response to the economic and social situation of the Member State concerned
C – the Plan does not contribute to addressing any challenges identified in the country-specific recommendations, or in other relevant documents officially adopted by the Commission under the European Semester and the Plan does not represent an adequate response to the economic and social situation of the Member State concerned
2.2. The Plan demonstrates that it has been prepared in full compliance with the partnership principle as set out in Article 6 of this Regulation and in accordance with the European Code of Conduct on Partnership.
When assessing the partnership principle, the Commission shall take into account:
(a) the completeness and quality of the information provided by the Member State;
(b) the extent to which the partnership principle has been effectively implemented, including the involvement of relevant partners throughout the preparation of the Plan and the consideration of their contributions;
(c) the robustness, relevance and analytical quality of the territorial assessment, including the identification of disparities, development needs and investment gaps, as well as the expected territorial impact of the proposed reforms and investments.
Rating
A - the Plan has fully complied with the European Code of Conduct on Partnership, all relevant partners have been clearly identified and broadly represented, involvement was timely, continuous and structures across all stages of the drafting and implementation of the Plan, consultation process was transparent and documented, partners’ contributions have demonstrably been reflected in the content of the Plan, appropriate governance mechanisms have been established to ensure ongoing participation, and partners have been called to provide certain research tasks in order to support the preparation of the Plan.
B - the Plan has partially implemented the European Code of Conduct on Partnership, partners have been identified but participation has been partial, late or uneven across all stages, consultation has been carried out but lacked sufficient transparency and documentation, the link between partners’ input and the final content of the Plan has been only partially addressed, governance arrangements for continued involvement have been limited or insufficiently detailed, and partners have not been informed timely.
C - the Plan has not implemented European Code of Conduct on Partnership, key partners have not been involved or inadequately informed, overall involvement of partners has been minimal, ad hoc or purely formal, consultation process has not been transparent or documented, there is no clear evidence that partners’ contributions have been included in the Plan, and the governance mechanisms for partnerships are absent or ineffective.
2.3. The Plan includes a territorial assessment covering economic, social and territorial disparities, development needs and investment gaps across regions, including urban, rural, coastal and cross-border areas.
When assessing the territorial impact, the Commission shall:
- provide the analytical basis for the selection and allocation of reforms and investments;
- demonstrate how the Plan contributes to economic, social and territorial cohesion;
- assess the expected territorial impact of the measures, including how regional and local specificities are taken into account.
A - the Plan has fully complied when it includes a comprehensive, evidence-based territorial assessment covering all relevant types of territories (urban, rural, coastal, cross-border, outermost where relevant), clearly identified disparities, development needs and investment gaps using appropriate data and indicators, directly linked the assessment to the selection and allocation of reforms and investments, systematically analysed the expected territorial impacts of measures, and clearly demonstrated how the Plan contributes to economic, social and territorial cohesion.
B - the Plan has provided a territorial assessment that is partial, uneven or lacks sufficient depth, key disparities or territories are insufficiently covered, the link between the assessment and the chosen measures is only partially demonstrated, territorial impacts are mentioned but not systematically analysed, and the contribution to cohesion is not fully substantiated.
C - the Plan does not include a territorial assessment, or the assessment is superficial and not evidence-based, major territorial disparities, needs or specificities are not identified, there is no clear link between analysis and the proposed reforms and investments, territorial impacts are not assessed, the Plan risks ignoring or exacerbating regional inequalities.
2.3 The Plan explains how the Member State’s systems and arrangements ensure the regular, effective and efficient use of Union resources in compliance with sound financial management, the protection of the Union’s financial interests and the key requirements set out in Annex IV, including measures to address identified deficiencies;
When assessing the adequacy of the Member State's systems and arrangements to ensure a regular, effective and efficient use of Union resources, the Commission shall take into account:
a) the completeness, consistency and quality of the information provided by the Member State regarding its management, control and audit systems, including the extent to which the arrangements described address the key requirements set out in Annex IV;
b) the adequacy of the proposed systems and procedures to ensure sound financial management, the legality and regularity of expenditure, the protection of the financial interests of the Union, and the reliability and quality of data supporting payment requests, monitoring and reporting;
c) the extent to which potential deficiencies and risks have been identified, together with the credibility, proportionality and feasibility of the corrective measures, implementation arrangements and resources foreseen to address them.
A - The management, control and audit systems described in the Plan fully comply with the key requirements set out in Annex IV and provide strong assurance regarding the legality, regularity, effectiveness and efficiency of Union expenditure. Responsibilities and procedures are clearly defined, adequately resourced and operational. Reliable systems are in place to ensure compliance with applicable law, the reliability of data, effective audit trails, timely recoveries and the protection of the Union’s financial interests. Any identified weaknesses are minor and accompanied by credible corrective measures.
B - The management, control and audit systems described in the Plan broadly comply with the key requirements set out in Annex IV, but certain weaknesses remain regarding the effectiveness, reliability or operational capacity of specific procedures or authorities. Corrective measures are identified but lack sufficient detail, resources or implementation timelines. The systems provide only partial assurance regarding the protection of the Union’s financial interests.
C - The management, control and audit systems described in the Plan do not adequately comply with the key requirements set out in Annex IV and fail to provide sufficient assurance regarding the legality, regularity, effectiveness or efficiency of Union expenditure. Significant deficiencies exist in the allocation of responsibilities, administrative capacity, audit arrangements, data reliability, financial management, recovery procedures or compliance mechanisms. Corrective measures are absent, insufficient or not credible.
2.4. The Plan is expected to ensure that no reform or investment measure included in the chapters of the Plan does significant harm to environmental objectives within the meaning defined in the Regulation (EU) xx/xxx [Performance Regulation] (the principle of ‘do no significant harm’).
The Commission shall take into account the following elements for the assessment under this criterion:
Scope
— no measure for the implementation of reforms and investments projects included in the recovery and resilience plan does significant harm to environmental objectives within the meaning of Article 17 of Regulation (EU) 2020/852 (the principle of ‘do no significant harm’).

— the plan contains measures that aim to foster economic growth and economic cohesion in an inclusive manner, in particular addressing weaknesses of the economy of the Member States, boosting the growth potential of the economy of the Member State concerned, stimulating job creation, and mitigating the adverse effects of the crisis; and
— the plan contains measures that aim to strengthen social cohesion and social protection systems, including policies for children and youth, by reducing social vulnerabilities, contributing to the implementation of the principles of the European Pillar of Social Rights; and
— the Plan aims to reduce economic vulnerabilities of the Member State to shocks; and
— the Plan aims to increase the capacity of the economic and/or social structures and institutions of the Member State to adjust to and withstand shocks; and
— the Plan is expected to contribute to enhancing economic, social and territorial cohesion and convergence.

2.8. The Plan is expected to ensure a high level of protection of the environment and human health through the application of the ‘no backsliding’ principle. The Commission shall take into account the following elements for the assessment of CAP chapter under this criterion:
— at least the equivalent actions for climate and environment and animal welfare exist in the CAP chapter within the NRP plans, with the same take-up as the eco-scheme and AECMs under CAP 2021-2027;
— Member States' definition of protective practices as part of farm stewardship in accordance with Article 3 [CAP reg.] does not lower the overall level of environmental protection.

Justification

The National Plans are expected to address a wide range of priorities in line with Article 2 and 3 of this Regulation. Clear requirements on what Member States must include in their plans is essential in this respect. We therefore, in this Annex, propose a structured & transparent methodology to ensure that the Commission assesses the NRPPs consistently, with a clear rating system. This Annex is in line with Article 22a and provides guidance for the Commission assessment. However, to ensure that this Annex is fully reflected to the realities, we call for the co-rapporteurs and the Parliament’s negotiation team to work on an annex together with the Commission.

Justification

The Commission proposal limits the ‘Unity’ safety net to disruptions in agricultural markets. However, extreme weather events, natural disasters, animal diseases, zoonoses and plant pests represent increasingly frequent and significant risks for the EU agricultural sector. The proposed extension would make it possible to strengthen the resilience of the European agricultural sector and ensure a more effective and coordinated response to the main crises affecting farmers.Furthermore, in order to make risk management tools more efficient and accessible across the EU, an EU insurance scheme would represent one of the most cost-effective instruments to increase farmers’ uptake of such tools and, consequently, to reduce the impact of crises and the need to activate costly exceptional measures.

Direct staff costs methodology
An hourly rate may be calculated in one of the following ways:
by dividing the latest documented annual gross employment costs by 1 720 hours for persons working full time, or by a corresponding pro-rata of 1 720 hours, for persons working part-time;
by dividing the latest documented monthly gross employment costs by the average monthly working time of the person concerned in accordance with applicable national rules referred to in the employment or work contract or an appointment decision (both referred to as the employment document).
When applying the hourly rate calculated in accordance with paragraph 2, the total number of hours declared per person for a given year or month shall not exceed the number of hours used for the calculation of that hourly rate.
Where annual gross employment costs are not available, they may be derived from the available documented gross employment costs or from the employment document, duly adjusted for a 12-month period.
Staff costs related to individuals who work on part-time assignment on the operation may be calculated as a fixed percentage of the gross employment costs, in line with a fixed percentage of time worked on the operation per month, with no obligation to establish a separate working time registration system. The employer shall issue a document for employees setting out that fixed percentage.

Commission methodology for the determination of payment suspension
I. Principles of the methodology
a) Unit value per NRPP
The basis for the calculation of the suspended amount is the ‘unit value’ of a milestone or target. To ensure a clear relationship between the value that is attributed by the Union to the implementation of the Plan and the suspended amount, the unit value of every milestone and target is calculated by dividing, for each Plan, its total value by the number of milestones and targets (total NRPP allocation/number of milestones and targets). E.g.: NRPP maximum financial contribution of EUR40 billion / 175 milestones and targets = unit value of EUR229 million for each milestone or target. For those Member States that have also requested a loan, there will be two different unit values, one for the milestones and targets foreseen under the non-repayable support part of their NRPP and one for those milestones and targets foreseen under the loan part.
b) Coefficients and upward and downward adjustments
To give due consideration to differences between the measures in the NRPPs and between milestones and targets, the Commission will calculate ‘corrected unit values’. To this end, the Commission will apply coefficients to the unit value. These coefficients are set by assessing the importance of each unfulfilled milestone or target and the depth of the implementation gap they represent.
Once corrected unit values are established, upward and downward adjustments will be made in the specific cases outlined below.
The final amount to be suspended per unfulfilled milestone or target will be equal to the corrected unit value subject to any upward and downward adjustment (‘suspension value’).
Investments
Coefficients applied to the unit value
1) A coefficient of 2 is applied for milestones and targets of large investments (accounting for more than 10% of the non-repayable support or loan) with a limited number of milestones and targets (at or below 5).
2) A coefficient of 0.5 is applied to:
● milestones and targets of the smallest investments (accounting for less than or equal to 0.1% of the non-repayable support or loan);
● intermediary milestones (i.e. not targets) that are followed by subsequent milestones and/or targets related to the same investment.
3) For all other milestones and targets, a coefficient of 1 is applied.
Adjustment of the corrected unit value
1) Proportional reductions to the corrected unit values are applied in the following cases:
● In case an investment target has not been satisfactorily fulfilled, the progress made towards achieving the target is assessed. The amount to be suspended is determined proportionally to the distance to the target. Such an approach is particularly relevant for targets for which this can be assessed quantitatively.
● For investment milestones, to the extent that it is possible to evaluate the share of what has been achieved.
2) Upward adjustments of the corrected unit values are applied if the investment is of major importance to justify any of the ratings underpinning the positive assessment of the NRPP.
Reforms
Coefficients applied to the unit value
1) A coefficient of 5 is applied for milestones and targets related to the entry into force of a reform or the final step for the implementation of a non legislative reform.
2) A coefficient of 0.5 is applied for any other milestones and targets, such as the ones related to intermediary steps before a milestone related to the entry into force of a given reform (e.g. publication of a report) or to ex-post procedural steps (e.g. evaluation of a reform).
Adjustment of the corrected unit value
1) Upward adjustments of the corrected unit values are applied if:
● The implementation of the reform is considered by the Commission of particular importance to justify the rating for addressing all or a significant subset of challenges identified in the relevant country specific recommendations, including fiscal aspects thereof and recommendations made pursuant to Article 6 of Regulation (EU) No 1176/2011 where appropriate, addressed to the Member State concerned, or challenges identified in other relevant documents officially adopted by the Commission in the context of the European Semester.
2) Downward adjustments of the corrected unit values are applied in the following cases:
● The reform is of less importance to justify any of the ratings underpinning the positive assessment of the NRRP.
● For reform milestones covering one or more than one policy objective or dimension, a proportional adjustment will be applied if the policy objective of the milestone is partly met or if some of the objectives/dimensions of the milestone are met and others are not. In considering such a downward adjustment, the substantive progress towards the achievement of the overall objective of the reform will be assessed.
Measures related to audit and control
To ensure the effective use of NRRP funds and protect the financial interests of the Union, the non-fulfilment of milestones or targets related to a Member State’s audit and control system that were necessary for complying with Article 22 of the RRF Regulation shall lead to the suspension of the full instalment and all future instalments.
II. Methodology for calculating suspension of payments for serious non-compliance
To be developed with the Commission.
III. Methodology for calculating suspension of payments for irregularity, including fraud, corruption, double funding or conflicts of interests affecting the financial interests of the Union, which was not detected and reported and corrected by the Member State;
To be developed with the Commission.
IV. Final remarks
Measures that do not respect the horizontal principles, including the Rule of Law and the Charter of the Fundamental Rights, are not eligible under the NRPP. Moreover, the milestones and targets of measures found in breach of these requirements would not be considered satisfactorily fulfilled, and this methodology would apply to determine the amount to be suspended.
