3a. 2.1. Member States may include contracted availability stocks in the preparedness and response plans referred to in this Article. For the purposes of this paragraph, ‘contracted availability stocks’ means quantities of products or production, processing, storage, transport or delivery capacities specifically reserved for release in emergency or major crisis situations and guaranteed by legally binding contractual agreements concluded with public or private operators.
Contracted availability stocks may only be recognised for the purposes of preparedness and response plans where they:
(a) give the competent public authority legally binding priority access or delivery rights;
(b) specify maximum time frames for release and delivery;
(c) provide for rotation, renewal and quality control requirements, where applicable;
(d) checked and audited regularly and effective, proportionate and dissuasive penalties for non-compliance are in place;
(e) are not counted twice or double funded under Union or national instruments;
(f) are demonstrably available and not subject to trade commitments that would prevent their timely release in an emergency or severe crisis.

Justification

Crisis preparedness should combine physical stockpiles with quantities and capacities already existing on the market but contractually pledged to public authorities. Contracted availability stocks can cut storage costs and waste, provided that strict safeguards ensure they are effectively available, traceable and ready for release.

Justification

While structured cooperation and information exchange between Member States and the Commission are essential for crisis preparedness, it is imperative that these mechanisms strictly respect the confidentiality of sensitive commercial and strategic data. The market intelligence and stock levels reported under these provisions often involve highly confidential business information which, if improperly disclosed, could distort competition or compromise national security reserves.Furthermore, the operational modalities of this cooperation must be carefully designed to prevent administrative duplication and avoid interfering with existing crisis management, civil protection, or emergency response frameworks already established at the Union or national levels. Ensuring a robust confidentiality safeguard is therefore necessary to guarantee the security of the shared data, protect market integrity, and maintain a coherent, non-overlapping crisis response infrastructure.

Justification

Crisis preparedness must take the entire value chain into account. Modern biorefineries are integrated producers of food and animal feed: ethanol production yields high-quality, GMO-free protein feed, which makes a significant contribution to the European protein strategy. Blanket bans on production would worsen, not improve, the security of feed supply; crisis-management measures must remain proportionate and evidence-based.

EU strategic food reserve.
1. Without prejudice to the national reserves referred to in Article 222d, the Union may establish a strategic food reserve for essential agricultural products, to be supplied through purchases made under public intervention.
2. The objectives of this reserve are to limit excessive price volatility, discourage speculative behaviour on agricultural markets and strengthen the Union’s food sovereignty in the face of supply crises.
3. 50 % of purchases under paragraph 1 shall be reserved for products certified in accordance with organic production standards, subject to market availability.
4. The Commission shall, within two years of the entry into force of this Regulation, submit a report to the European Parliament and to the Council assessing the feasibility of such a reserve and the budgetary implications thereof.

Transparency of cross-border central purchasing bodies.
1. Central purchasing bodies or purchasing alliances bringing together operators from several Member States and collectively negotiating the purchase of agricultural or food products shall declare their legal structure, members and the volume of purchases negotiated on their behalf to the Commission and the competent authorities of the Member States concerned.
2. The Commission shall publish annually a report on the practices of these structures and their impact on the distribution of added value along the supply chain, and it shall assess whether it is appropriate to propose measures to protect agricultural producers from unfair contractual practices, added-value appropriation and unfair competition under European social and environmental laws. ’
3. Where it is established that a central purchasing body or purchasing alliance as referred to in paragraph 1 organises or facilitates, through the creation of competition among its members established in different Member States, the circumvention of social, health or environmental provisions applicable in the producer Member State, or substantially and repeatedly undermines the fair distribution of added value to the detriment of agricultural producers, the Commission:
(a) shall impose administrative fines of up to 4 % of the global annual turnover of the structure concerned and, jointly and severally, of its members, without prejudice to more severe penalties laid down in national law;
(b) may, where non-compliance is serious, repeated or not remedied within 12 months, impose proportionate structural measures including the dismantling of the central purchasing body or purchasing alliance, or the prohibition of cross-border collective bargaining for the product categories concerned;
(c) shall ensure that no contractual practice, legal arrangement or relocation of the negotiating seat may have the effect of exempting such structures from the application of this Article or of circumventing the sovereign decisions of Member States in social, health, environmental or agricultural policy matters;
(d) shall cooperate with the competent authorities of the Member States concerned to ensure the cross-border effectiveness of such penalties, including through the mutual recognition of decisions to dismantle or prohibit such structures.
Member States shall retain the right to adopt or maintain national measures that offer greater protection for agricultural producers and for the sovereignty of their social and environmental choices, and under no circumstances may these provisions be invoked to weaken them.

Justification

Central purchasing bodies operating at transnational level are exerting increasing pressure on agricultural prices, exploiting regulatory and social disparities between the Member States. In the absence of a transparency framework, these structures are largely outside the control of national competition authorities and commercial practice regulators, which calls for a reporting and monitoring mechanism at Union level, complementary to the food safety provisions of this Chapter.

2. Member States financing such operational programmes under their CAP Strategic Plans shall ensure that, by [15 September 2027], producer organisations, associations of producer organisations or, where applicable, other beneficiaries referred to in Article 67(1), point (b), of Regulation (EU) 2021/2115 submit to the competent national authorities a request:
(a) to modify their operational programme so that it complies with Regulation (EU) No 1308/2013 and this Regulation; or
(b) to replace it with a new operational programme complying with Regulation (EU) No 1308/2013 and this Regulation; or
(c) to continue implementing it until its end in accordance with, and under the financial conditions laid down in, Regulations (EU) 2021/2115 and (EU) 2021/2116.
If no such request is submitted by [15 September 2027], operational programmes approved under Regulation (EU) 2021/2115 shall terminate on 31 December 2027."

Regulation (EU) No 228/2013 is amended as follows:
(1) Article 22a is replaced by the following:
‘Article 22a
Interbranch agreements in the outermost regions
1. Pursuant to Article 349 of the Treaty on the Functioning of the European Union, by way of derogation from Article 101(1) of that Treaty and notwithstanding the first subparagraph of Article 164(4), points (a) to (n) of Regulation (EU) No 1308/2013, where an interbranch organisation recognised under Article 157 of Regulation (EU) No 1308/2013 operates exclusively in one of the outermost regions referred to in Article 349 of that Treaty and is considered to be representative of the production, trade or processing of a given product, the Member State in question may, with a view to improving food security in that region, and at the request of that organisation, extend to other operators who are not members of that interbranch organisation the rules designed to foster the maintenance and diversification of local production, provided that those rules apply only to operators whose activities are carried out exclusively in that region and involve products intended for the local market. Notwithstanding Article 164(3) of Regulation (EU) No 1308/2013, an interbranch organisation shall be regarded as being a representative under this Article where it accounts for at least 70 % of the volume of production, trade or processing of the product or products concerned.
2. By way of derogation from Article 165 of Regulation (EU) No 1308/2013, where the rules of a recognised interbranch organisation operating exclusively in the outermost regions referred to in Article 349 TFEU are extended under paragraph 1 of this Article, and the activities covered by those rules are in the general economic interest to economic operators whose activities are exclusively carried out in the same outermost region and involve products destined for the local market, the Member State in question may, after consulting the relevant stakeholders, decide that individual economic operators or groups which are not members of the organisation but operate on the local market are to pay the organisation all or part of the financial contributions paid by its members, provided that those contributions are intended to cover costs directly incurred as a result of the pursuit of the activities in question.
3. The Member State shall inform the Commission of any agreement whose scope is extended in accordance with this Article.
’

A mechanism for stabilising the markets in speciality sugars produced in the outermost regions shall be introduced, taking into account the specific structural social and economic situation of the regions concerned, which is exacerbated by their remoteness, insularity, small size, difficult topography and climate, and by their economic dependence on a limited number of products.
2. The mechanism shall include:
(a) for each tariff line corresponding to the market for speciality sugars, a minimum annual reference price shall be introduced, based on the average EU import price recorded during the October 2023-September 2024 sugar marketing year:
(i) for code 1701 1490, the price shall be set at EUR 857/tonne;
(ii) for code 1701 1390, the price shall be set at EUR 1 284/tonne;
(iii) for code 1701 9100, the price shall be set at EUR 2 199/tonne;
(iv) for code 1701 9990, the price shall be set at EUR 994/tonne.
This price shall be reassessed every year to take account of inflation (euro area index).
(b) a variable market support duty when the CIF import price is lower than the reference price; that duty shall be equal to the difference between the reference price and the import price, up to a maximum of EUR 419/tonne;
(c) the customs entry points for the European market as a whole shall be designated by the competent authorities of the Member States, which shall be responsible for the implementation of this measure.

Its provisions shall contribute to the objectives of the common agricultural policy set out in Article 39 TFEU, in particular to stabilising markets, assuring the availability of supplies, ensuring a fair standard of living for the agricultural community and strengthening the competitiveness of the Union’s agri-food sector.
This Regulation shall determine, in particular, market and sectoral interventions, crisis prevention and management measures, the EU school scheme, agricultural derogations from competition rules, marketing standards and instruments aimed at strengthening producers’ position in the value chain.
Union quality policy and sectoral interventions shall also contribute to the economic and territorial development of rural areas.

I fiori eduli sono fiori coltivati per essere mangiati e sono a tutti gli effetti utilizzati come prodotti ortofrutticoli, similarmente ai fiori di zucca/zucchine, ai capperi (boccioli non ancora aperti), ai carciofi (boccioli dei fiori non ancora aperti). Il mercato europeo dei fiori eduli è una componente fondamentale di un mercato globale del valore di circa 440-476 milioni di dollari, con un tasso di crescita annuo composto compreso tra il 5% e il 6,5%.È inoltre essenziale prevedere un meccanismo agile per aggiornare tempestivamente i codici NC di tutte le nuove produzioni di nicchia o derivanti da nuove tecniche colturali, al fine di evitare costanti contestazioni in fase di audit regionale sul calcolo del VPC.

They shall provide, at a minimum, for: - rules on sampling and methods for determining gross weight, tare weight, and sugar content; - a proposed method for calculating the price, taking into account, in particular, the sugar content of the cane through a scale and the quantity of cane delivered.
2. Interprofessional agreements may provide for: - a standard template for delivery contracts that is consistent with this Regulation and Union rules; - conciliation or mediation mechanisms and arbitration clauses.
3. A sugar company and the relevant sugarcane sellers may agree on value-sharing clauses, relating in particular to gains and losses recorded on the market, in order to determine how any changes in relevant prices on the sugar market or other commodity markets are to be shared between them.
SECTION II
1. On the basis of the aforementioned interprofessional agreements, delivery contracts may be concluded.
2. Such contracts may be multi-year in duration and may, in particular, provide for: - the purchase price for the quantities specified in the contract, which may be adjusted by applying price premiums or discounts corresponding to differences in quality; - the terms under which an additional quantity of sugarcane may be supplied; - the locations for receiving the sugarcane and for taking samples; - a method agreed upon by both parties for determining the sugar content; - the deadlines for payment of any installments and for the balance of the purchase price of the sugarcane.

Honey vinegar is a traditional fermented product obtained exclusively from honey via a dual process of bio-fermentation (alcoholic and acetic fermentation). Reserving this name for products genuinely derived from honey protects consumers from misleading or unfair practices, and generates added value for the European beekeeping sector. What is more, granting legal protection for honey vinegar is in keeping with the approach already adopted for other agricultural products whose name is linked to the raw material from which they derive.

Justification

This text created problems for hybrid products - products which do contain meat but at lower percentage, combined with a (often plant-based) alternative component. These formulations provide consumers with certain health benefits or simply the option to follow their dietary preferences of consuming less meat. However, the alternative component is an intentional part of the formulation and it does in part "take or is intended to take the place of (a) meat constituent". The old wording would complicate, even prohibit a clear communication to consumers about the nature of these products
