| 1. By way of derogating from Article 28, paragraphs, (1) – (4), Member States may establish a Healthy School Meal Component within the Union School Scheme. | |
| 2. The Healthy School Meal Component shall provide participating pupils with at least one healthy meal per school day, in accordance with national nutritional standards and Union public health objectives. | |
| 3. The meal shall, where appropriate, make use of fresh, seasonal and locally produced agricultural products and may include products supplied under the Union School Scheme. | |
| 4. Financing may be provided through: | |
| (a) Union support under this Regulation; | |

Justification
The term "accompanying educational measures" is structurally and conceptually superior to the newly proposed "awareness-raising measures." Historically, this policy component evolved from "accompanying measures" under the original School Fruit Scheme to "accompanying educational measures" when the programs were integrated under the current School Scheme. Reverting to "awareness-raising measures" weakens the core objective of the policy.A clear legal distinction must be maintained between general public communication and targeted school interventions: "awareness-raising" is typically deployed in relations with the general public (as seen in Article 23a(7) of Regulation (EU) No 1308/2013), whereas "accompanying educational measures" is strictly reserved for the program's specific target group (schoolchildren). The fundamental rationale of this policy dictates that the mere distribution of agricultural products, in the absence of a robust, structured educational component, is insufficient to achieve the long-term objective of building sustainable and healthy dietary habits. Therefore, the explicit educational character of these measures must be preserved in the legislative text.

Justification
The provision of Article 35(6) of the draft NRP regulation concerning the financing of the school scheme should be transferred to the CMO regulation. Such an approach rationalizes the placement of provisions and enhances legislative transparency. The threshold of total amount of the public expenditures for awareness-raising activities should be increased from 15% to 20%. One of the most important objective of the school scheme is raising awareness about healthy eating habits, which is effectively ensured by the educational component. In order to provide more flexibility for Member States, the maximum share of school scheme budget that can be used for such activities needs to be increased.

| (b) the level of regional development within each Member State, ensuring that higher aid intensities are directed toward less developed regions and the smaller Aegean islands within the meaning of Article 1(2) of Regulation (EU) No 229/2013; | |
| (c) for school milk, in addition to the criteria laid down in points (a) and (b), the historical absorption rate of Union aid for the supply of milk and milk products to children. | |
| 3. The allocation methodology shall guarantee that higher aid is granted to the outermost regions listed in Article 349 TFEU to account for their specific supply-chain constraints and to incentivize regional sourcing between geographically proximate outermost regions. Furthermore, the allocation for school milk shall guarantee that all Member States receive a minimum threshold of Union aid per child within the age cohort specified in point (a) of the first subparagraph. Measures concerning the fixing of indicative and definitive allocations, as well as the reallocation of Union aid for school fruit and vegetables and for school milk, shall be adopted by the Council in accordance with Article 43(3) TFEU. | |
| 4. Member States wishing to participate in the school scheme shall submit every year their request for Union aid, specifying the amount requested for the school fruit and vegetables and the amount requested for the school milk that they wish to distribute. | |
| 5. Any Member State may transfer once per school year up to 20 % of either one or the other of its indicative allocations. That percentage may be increased up to 25 % for the Member States with outermost regions listed in Article 349 TFEU and in other duly justified cases, such as where a Member State needs to address a specific market situation in the sector covered by the school scheme, its particular concerns regarding low consumption of either one of the groups of products, or other societal changes. | |
| Transfers may be made either: | |
| (a) prior to the fixing of definitive allocations for the following school year, between the Member State's indicative allocations; or | |

Sectoral interventions in niche sectors (protein, hops, hemp and flax) should be available for implementation by other actors (e.g. individual farmers or processors) and not only by producer organisations and their associations. Restricting sectoral interventions to organised entities limits the possibilities of implementing sectoral interventions, as there are no strong traditions of organizing. The philosophy of implementing sectoral interventions could be modified, especially in relation to certain agricultural markets, e.g. niche or recovering markets such as: high protein, fibrous, hops, etc. Interventions in certain markets should not consist solely of the implementation of operational programmes by producer organisations, but could be support dedicated to a given sector in order to address specific problems in a given market or the development of a given sector.

The maximum support rate applicable to those interventions shall be 75 % of the total eligible costs of each intervention. By way of derogation from the first and second subparagraph, the minimum national contribution to the eligible public expenditure of interventions in the apiculture sector implemented by beneficiaries other than producer organisations, associations of producer organisations or identified producer groups shall be at least equal to the Union financial assistance granted for these interventions. By way of derogation from the second subparagraph, Member States may decide to increase the maximum support rate to up to 95 % of the total eligible costs of each intervention for interventions linked to generational renewal, research and innovation, risk management or environment and climate, and for producer organisations implementing operational programmes for the first time. By way of derogation from the second subparagraph, Member States may also decide to compensate 13 producers for loss of income due to the implementation of the interventions referred to in Article 31, point (n), of Regulation (EU) No 1308/2013, by covering up to 100 % of the relevant loss for a maximum period of three years. By way of derogation from the second subparagraph, Member States may decide to increase the maximum support rate for interventions concerning market withdrawals for free distribution to 100 % for market withdrawals which do not exceed 5 % of the volume of the production marketed by a producer organisation. The volume of the production shall be calculated as the average of the overall volumes of products for which the producer organisation is recognised and which are marketed by the producer organisation during the three previous years. Member States shall ensure that the compensation granted for market withdrawals does not exceed the market price of the withdrawn products. By way of derogation from the second subparagraph, Member States may decide to increase the maximum support rate for interventions related to investments under paragraph 1, point (i), for the restoration of production capacity following exceptional events to 100 %. |

The scope of eligible actions should be extended to include measures to improve the sustainability and efficiency of distribution systems. Reusable crates, including foldable ones, are an effective solution to reduce the environmental impact associated with the transport and distribution of fruit and vegetables. Their environmental benefits were assessed and quantified through a 10-year Life Cycle Assessment (LCA) study conducted by the University of Bologna’s Faculty of Engineering.
