Justification

Social conditionality leads to double penalties for non-compliance and creates disproportionate bureaucracy without substantial added value and must be removed from CAP conditionality.

The amendment aims to maintain a clear, proportionate and workable conditionality system based on a common legal baseline. Protective practices should therefore be removed, as they would introduce a more complex, less predictable and more unevenly implemented systém across the Union.

This would risk repeating the shortcomings of the current conditionality system, which has been widely criticised for creating a disproportionate administrative burden for farmers, paying agencies and national authorities.

To ensure legal consistency with Article 4(1)(c), the protective practices listed in Annex I must explicitly reflect the most effective agronomic tools for soil preservation. Crop rotation alone does not prevent soil erosion. Explicitly including 'continuous soil cover', 'multi-species cover crops', and 'minimal soil disturbance' ensures that Member States have a clear, binding framework to support farmers who implement these advanced regenerative practices.

Justification

Protective practices are particularly problematic because they may be defined or applied differently at national or regional level. This would create a high risk of divergent implementation, unequal treatment of farmers and further renationalisation of the CAP. Farmers in different Member States could be subject to substantially different baseline obligations while receiving support under the same EU policy. Such an approach would undermine the common character of the CAP and weaken the level playing field between farmers across the Union.

The deletion of protective practices would therefore make the system more proportionate, legally clearer and administratively feasible. It would keep conditionality focused on a common, legally defined baseline, while allowing higher environmental and climate ambitions to be achieved through voluntary, targeted and adequately funded CAP interventions.

When defining GAEC 2, Member States must ensure that agricultural activity suitable for classifying the land in question as agricultural land can be maintained on that land. (1)The buffer strips along watercourses provided for in this GAEC standard must, as a general rule and in accordance with Union law, be at least 3 metres wide and free from the use of pesticides and fertilisers. In areas characterised by a significant presence of drainage and irrigation channels, Member States may, where duly justified for such areas, adjust the minimum width in accordance with specific local circumstances. Les États membres, lorsqu'ils établissent la norme BCAE n° 2, veillent ace qu'une activité agricole permettant de qualifier Les terres concernées de « surfaces agricoles» puisse y être maintenue.

Les bandes tampons le long des cours d'eau prévues par la présente norme GAEC doivent, en règle générale et conformément au droit de l'Union, respecter une largeur minimale de 3 mètres sans utilisation de pesticides ni d'engrais.

Dans Les zones comportant d'importants fosses de drainage et d'irrigation, Les États membres peuvent, si cela est dument justifie pour ces zones, adapter la largeur minimale en fonction des circonstances locales spécifiques.

Les États membres peuvent utiliser, aux fins de la présente norme BCAE, la définition des cours d'eau prévue par la législation nationale, à condition que cette définition soit conforme à l'objectif principal de la présente norme BCAE.

Lorsqu'ils définissent Les exigences en matière de diversification des cultures, les États membres respectent Les exigences minimales suivantes :

(a) lorsque plus de 75 % des terres arables sont utilisées pour la production de graminées ou d'autres fourrages herbacés, sont mises en jachère, sont utilisées pour la culture de légumineuses ou font l'objet d'une combinaison de ces utilisations ;

Rules concerning the calculation of animal equivalents for the purpose of Coupled income support referred to in Article 11

Member States shall use the following coefficients to convert animals to animal equivalents for the purpose of the coupled income support interventions referred to in Article 11(1). Where support is granted to sectors or types of production for which this Annex contains no suitable coefficients, including apiculture products and silkworms, Member States may establish, in their NRP Plans, specific equivalent units on the basis of objective and non-discriminatory criteria.

Justification

Article 11 allows coupled support to be granted to sectors such as the apiculture and silkworm sectors, but Annex II does not provide suitable equivalence for those sectors.
