| (6) In order to further improve its reactivity to unwarranted price fluctuations and increase market predictability, the mechanism to enhance price stability in the first three years of the emissions trading system for buildings, road transport and additional sectors should be strengthened in a careful manner. This could involve releasing a higher volume of allowances in the market. If the measure is applied twice during the same 12 months period, the additional release should occur twice. | As long as the emissions trading system for buildings, road transport and additional sectors is in place, the mechanism to limit excessive price increases must react effectively and automatically. If the price level referred to in Article 30h(2) of Directive 2003/87/EC is reached, a significantly higher amount of allowances should be released from the reserve without delay. If the measure is triggered twice during the same 12-month period, the additional release should also occur twice in full. Priority must be given to limiting disproportionate heating, mobility and operational costs for households and businesses. |

If the ETS2 is to remain in place despite the burden it imposes, the price intervention mechanism must be effective. In the event of excessive price increases, significantly more allowances should be released immediately to limit additional heating, mobility and operating costs for citizens and businesses.

| (6a) The review of the market stability reserve for buildings, road transport and other sectors should take full account of the real economic and social impact of the emissions trading system. Where significant adverse impacts on households, mobility, competitiveness or small- and medium-sized enterprises are identified, the review should also cover the suspension or repeal of the emissions trading system regulated under Chapter IVa of Directive 2003/87/EC as a legislative option. |

Justification
A mere technical review of the reserve is not enough. If there are significant burdens, the very continuation of ETS2 itself should be called into question. Including suspension or repeal as a legislative option preserves the fundamental opposition to the system, without giving the decision itself a repeal effect beyond the scope of its subject matter.

Justification
Die Streichung hat dieselbe unmittelbare materielle Wirkung wie der Vorschlag der Kommission, bietet jedoch eine klarere und angemessenere legislative Lösung. Artikel 5 des Beschlusses (EU) 2015/1814 betrifft das Inkrafttreten dieses Beschlusses und sollte nicht dazu genutzt werden, eine operative Bestimmung dauerhaft unanwendbar zu machen. Durch die vollständige Streichung von Artikel 1 Absatz 5a werden zudem jegliche Unsicherheiten hinsichtlich des fortbestehenden rechtlichen Status des Ungültigkeitsmechanismus beseitigt und ein klarer konsolidierter Text geschaffen.

Justification
Article 30h(2) of Directive 2003/87/EC already provides for the release of 20 million allowances when the price limit is exceeded. The additional release of 80 million increases the total amount per trigger to 100 million. A short approval period helps to ensure that the price change takes effect immediately.

| In Article 3 of Decision (EU) 2015/1814, the following paragraph is added: ‘The review of the market stability reserve for buildings, road transport and other sectors shall in particular assess the evolution of allowance prices, consumer prices, heating and mobility costs, the impact on competitiveness and small- and medium-sized enterprises, regional disparities, energy and mobility poverty and the interaction with existing national measures. The review shall also assess whether price stability mechanisms suffice for preventing disproportionate cost increases. Where significant adverse economic or social impacts are identified, the Commission shall assess the need for legislative action in relation to the emissions trading system for buildings, road transport and additional sectors and submit a legislative proposal to the European Parliament and to the Council to that effect.’; |

Justification
The review must take stock of real cost effects on a mandatory basis. If significant burdens are identified, the Commission must not stop at a technical assessment but must consider whether legislative changes are needed. The proposal thus remains within the scope of the MSR Decision.
