(2) Decision (EU) 2015/1814 of the European Parliament and of the Council3 established a market stability reserve in order to mitigate the risk of supply and demand imbalances associated with the start of emissions trading for the buildings, road transport and additional sectors, as well as to make it more resistant to market shocks.(2) Decision (EU) 2015/1814 of the European Parliament and of the Council established a market stability reserve in order to mitigate the risk of supply and demand imbalances on the European CO₂ market and to improve its resilience to shocks. The invalidation mechanism set out in Article 1(5a) was introduced to eliminate the historical surplus of allowances that had arisen as a result of the 2008 economic crisis and the use of international credits. This historical surplus has been eliminated and, as the Commission notes, the balance between supply and demand has been restored. The invalidation mechanism should therefore not become a permanent means of reducing the cumulative quantity of allowances available on the market to below the level that would result solely from the cap.

Die Kommission führt in ihrer Begründung aus, dass der Ungültigkeitsmechanismus sein spezifisches Ziel, nämlich den historischen Überschuss auf dem Zertifikatemarkt abzubauen, erfolgreich erreicht habe und dass das Gleichgewicht zwischen Angebot und Nachfrage im EU-Emissionshandelssystem wiederhergestellt worden sei. Ein Mechanismus, der das spezifische Ziel, für das er eingeführt wurde, erreicht hat, sollte nicht standardmäßig weiterhin das kumulierte Angebot an Zertifikaten dauerhaft verringern. Dieser Änderungsantrag lässt die grundsätzliche Ablehnung des EU-Emissionshandelssystems durch die ESN-Fraktion und ihre Position zugunsten dessen Abschaffung unberührt.

(3) The analysis carried out of the expected functioning of the reserve, taking into account recent information, indicates that targeted amendments to some parameters would contribute to improving market predictability and to the stability of price movements in the early years of the new system.(3) An analysis of the proper functioning of the European CO₂ market and the market stability reserve, carried out in accordance with Article 3 of Decision (EU) 2015/1814, indicates that, in order to increase long-term market predictability, allowances held in the reserve in excess of 400 million should no longer be considered invalid. Since this provision came into force in 2023, 3.2 billion allowances have been declared invalid. The Commission has concluded that continuing to declare allowances invalid would increase overall scarcity in the market and lead to higher prices both now and in the future. The invalidation mechanism has thus fulfilled its stated purpose, whilst its continued application would result in a permanent reduction in the cumulative supply of allowances compared with the level determined solely by the cap, as well as additional costs for installations covered by the EU ETS. In the interests of legal clarity and long-term predictability, Article 1(5a) of Decision (EU) 2015/1814 should therefore be deleted rather than merely suspended.

Justification

Die Feststellungen zum historischen Überschuss, zur Wiederherstellung des Gleichgewichts zwischen Angebot und Nachfrage sowie zu den Auswirkungen einer fortgesetzten Ungültigkeitserklärung stammen aus der Begründung der Kommission zu KOM(2026) 153 endg. Sollte eine fortgesetzte Ungültigkeitserklärung die Knappheit verstärken und sowohl heute als auch in Zukunft zu höheren Preisen führen, sollte die Bestimmung aus dem Gesetzestext gestrichen werden, anstatt sie beizubehalten und gleichzeitig unanwendbar zu machen. Eine Streichung sorgt für größere Rechtsklarheit und verhindert das Fortbestehen einer Bestimmung, deren ausdrücklich genannter Zweck bereits erreicht wurde.

(3) The analysis carried out of the expected functioning of the reserve, taking into account recent information, indicates that targeted amendments to some parameters would contribute to improving market predictability and to the stability of price movements in the early years of the new system.(3) The emissions trading scheme for the buildings, road transport and additional sectors imposes additional costs on households, consumers and businesses through the carbon pricing of fuels and should be abolished. Whilst it remains in force, amendments to the market stability reserve must not lead to an artificial shortage of allowances or to additional price pressures. Such amendments should be based on robust evidence regarding actual market and price developments and should be aimed exclusively at limiting disproportionate price rises and economic and social burdens. Measures to limit such burdens do not constitute political endorsement of the emissions trading scheme for these sectors.

Justification

The extension of emissions trading to buildings and road transport places a burden on citizens and businesses through higher heating and fuel costs. As long as ETS2 remains in place, any changes to the market stability reserve must be made solely to minimise damage and must not be interpreted as an endorsement of the system.

(3a) The emissions trading scheme for the buildings, road transport and additional sectors may place a significant additional burden on households, businesses and consumers. When designing the market stability reserve, particular consideration should therefore be given to the impact on heating and transport costs, low- and middle-income households, rural regions, small and medium-sized enterprises, and the risk of exacerbating energy and transport poverty. The Social Climate Fund is not designed to fully and permanently offset all the additional burdens arising from the emissions trading scheme.

ETS2 can place a particular burden on low- and middle-income households, rural areas and small businesses. The Social Climate Fund does not fully offset these burdens. The market stability reserve must not exacerbate cost increases by causing further shortages of allowances.

(3b) The Emissions Trading Scheme for the buildings, road transport and additional sectors (ETS2) should be abolished, and the provisions of EU law relating to the introduction and implementation of this scheme should be repealed, in order to avoid placing an additional burden on citizens and businesses, particularly through higher heating and transport costs.

(4a) Several Member States have already introduced national CO₂ pricing mechanisms or other regulatory measures for buildings and road transport. When designing and reviewing the market stability reserve, account should be taken of existing national measures, cumulative burdens should be avoided, and Member States’ policy discretion should be preserved in accordance with the principle of subsidiarity.

Member States have different energy systems, transport structures and national CO₂ pricing mechanisms. The design of the Reserve must avoid creating cumulative burdens and preserve national scope for action in accordance with the principle of subsidiarity.
