On the proposal for a regulation of the European Parliament and of the Council establishing a budget expenditure tracking and performance framework and other horizontal rules for the Union programmes and activities
The Committee on Women's Rights and Gender Equality gives its opinion on the proposed regulation establishing a budget expenditure tracking and performance framework. It proposes amendments to strengthen gender equality as a horizontal principle across all Union programmes and activities.¶¶¶ The amendments require gender equality tracking based on OECD standards, gender equality scores for activities, and a spending target. They also require sex-disaggregated data, gender-focused evaluations, and exclusion of funding to organisations undermining gender equality.¶¶¶ The opinion notes that the 2028-2035 multiannual financial framework has no earmarked funding solely for gender equality, ending over 30 years of such funding. It cites that only 12 % of the Union budget (EUR 158.4 billion) between 2021 and 2024 supported gender equality.¶¶
Position. The Committee on Women's Rights and Gender Equality proposes amendments to the proposed regulation to strengthen gender equality as a horizontal principle, introduce gender equality scores and a spending target, require sex-disaggregated data and gender-focused evaluations, and exclude funding to organisations undermining gender equality.¶¶¶
Key points

It requires Member States to demonstrate national or regional frameworks for active labour market policies, gender equality, education, anti-discrimination, health and long-term care, social economy, and social inclusion.¶
It requires data collection to be broken down by sex and to enable identification of beneficiaries and the impact of programmes on gender equality.¶¶
It requires the Commission to report regularly on the share of expenditure contributing to gender equality (scores 2 and 1), supported by EIGE.¶
It requires evaluations to focus on gender equality and to ensure no funded activities negatively impact gender equality, with implementation reports published one year after the start of implementation.¶¶
It requires Member States to carry out interim evaluations one year after the start of implementation, using experts specialised in gender budgeting and gender mainstreaming, and to collect sex-disaggregated data.¶¶¶
It adds programmes to Annex IV, including the European Fund for Economic, Social and Territorial Cohesion, Agriculture and Rural, Fisheries and Maritime, Prosperity and Security, AgoraEU, and others.¶¶¶
Who is affected
Member States, which must demonstrate national frameworks, carry out evaluations, and collect sex-disaggregated data.¶¶¶

The budget is the main tool for political action, as it sets out the future and where we want to go. And the European Union’s budget has a great impact on people’s lives both within and outside Europe, of course on women´s lives everywhere. The EU’s next long-term budget represents a key opportunity to safeguard and strengthen prosperity, peace and democracy, based on gender equality, social priorities and environmental sustainability.
Implementation of gender equality throughout the MFF is not fully realised, since it appears as horizontal principle but is far from being on the same level as social or climate ones and its integration is less comprehensive and less institutionalised due to differences in marker methodologies, with most limited range of application, with no spending target, with no “do no significant harm” method accounting for potential negative effects, and finally it constitutes the weakest link among the objectives set out in the proposed programme regulations, despite the provisions of Article 8 of TFEU “In all its activities, the Union shall aim to eliminate inequalities, and to promote equality, between men and women”.
Achieving real gender equality requires a more transformative approach which involves examining and redesigning systems and structures. This implies expanding the application of gender mainstreaming to cover all MFF programmes and ensuring that it is applied consistently across the EU budget. We need to bring gender equality into all policies. In an ideal scenario, with specific training in gender mainstreaming and policies aligned to, we would be looking at a sound regulatory proposal from the Commission. But the reality is what it is, and we run the risk that the well-conceived, cross-cutting theoretical principle of gender equality will be watered down when put into practice, and with that, in the end, we will take a step backwards rather than forwards.
Until now, the EU has relied on a dual approach to gender equality. On the one hand, there are specific actions and targeted funding for gender equality, secured through programme-specific gender equality objectives. On the other, there is gender mainstreaming throughout the budget cycle from programming to implementation and evaluation, including through expenditure tracking from 2021-2027 period. The MFF 2028-2035 has no earmarked funding solely dedicated to promoting gender equality, marking the end of a period of more than 30 years in which Europe, following the Beijing Conference and the introduction of gender mainstreaming, has funded projects to advance gender equality.
The Rapporteur reminds that international standards, such as the OECD and EIGE’s tracking methodology, establish mandatory gender impact assessment, gender analysis to inform the design of the interventions, explicit gender equality objectives and a “do not harm” approach. The Rapporteur also underlines the importance of broadening the areas of intervention in gender equality to reflect the EU´s gender equality objectives, such the ones of the Roadmap of Women´s Rights developed into Gender Equality Strategy 2026-2030, proposes a spending target for funding and new coefficients for application. Europe has made significant progress on gender equality, but gender mainstreaming remains an unfinished task. In the current climate, marked by a strong backlash against women’s rights, there is a need for greater and more effective integration of a gender perspective in the EU budget.

In particular, rules should be established on monitoring of budget spending, on monitoring and reporting on the performance of Union programmes and activities, as well as rules on evaluation of the programmes and activities. This Regulation also aims to set out common rules to ensure a uniform application of the ‘do no significant harm’ and gender equality principles; as well as other common rules applicable across the budget such as those for establishing a Single Gateway, and rules on information, communication and visibility. The Commission may put in place additional elements for monitoring and reporting, including relevant indicators, for the purpose of measuring the impact of Union policies and actions more widely.

This Regulation also aims to set other common rules applicable across the budget such as those for establishing a Single Gateway, and rules on information, communication and visibility. The Commission may put in place additional elements for monitoring and reporting, including relevant indicators, for the purpose of measuring the impact of Union policies and actions more widely.

It is in particular essential to enhance the Union’s and Member States’ capability to anticipate, prepare for, and respond to crises, disasters and impacts of climate change and extreme weather events, and to protect the investments under the EU budget. Deploying new innovative technologies and solutions boosting climate resilience will at the same time increase the competitive edge of the EU companies not only through their improved adaptive capacity and climate resilience but also due to new export opportunities.

A system should be put in place to ensure a systematic and transparent monitoring of the contribution from the budget towards those social objectives within the Union. It is important in particular to promote social rights and fair working and labour conditions, in line with the European Pillar of Social Rights and in accordance with Article 9 TFEU and Article 33(2), point (e), of Regulation (EU, Euratom) 2024/2509, which lays down the requirement for programmes and activities to be implemented, where feasible and appropriate, respecting working and employment conditions under applicable national law, Union law, International Labour Organization conventions and collective agreements.

Text proposed by the Commission(8) In line with Article 8 TFEU, the Union shall in all its activities aim to eliminate inequalities, and to promote equality, between men and women. Article 33(2), point (e), of Regulation (EU, Euratom) 2024/2509 therefore lays down the requirement for the implementation of programmes and activities to take into account the principle of gender equality in accordance with an appropriate gender mainstreaming methodology, where feasible and appropriate. This Regulation should therefore establish a single set of rules to implement the principle of gender equality consistently. In particular, this Regulation should set out the gender mainstreaming methodology, building on the methodology developed by the Commission under the 2021-2027 MFF and used for the first time for the financial year 2021, to measure expenditure contributing to gender equality through a system of scores based on the objectives pursued by activities supported under Union programmes. Further guidance should be provided by the Commission to ensure the consistent application of that principle. This Regulation should also specify which data collected in relation to performance indicators should be broken down, where feasible and appropriate, by gender.
Amendment(8) Gender equality is a core value of the Union as enshrined in Article 2 TEU. In line with Article 8 TFEU, the Union shall in all its activities aim to eliminate inequalities, and to promote equality, between men and women, thus applying the principle of gender mainstreaming which stipulates that a gender equality perspective must be integrated across all policies and programmes, including budgetary policies. Article 33(2), point (e), of Regulation (EU, Euratom) 2024/2509 therefore lays down the requirement for the implementation of programmes and activities to take into account the principle of gender equality in accordance with an appropriate gender mainstreaming methodology, where applicable in line with applicable sector-specific legislation. This Regulation should therefore establish a single set of rules to implement, track and monitor the principle of gender equality consistently aiming to promote and support gender equality and eliminate inequalities. In the context of increasing backlash against gender equality and women’s rights across the Union and globally, the budget of the Union should contribute to protecting gender equality, combating discrimination and promoting equal opportunities for all. In particular, this Regulation should set out the gender mainstreaming methodology, building on the comprehensive methodology developed by the Commission and applied in funds under the 2021-2027 MFF since the financial year 2021, to ensure that gender equality is systematically integrated into all programmes and to measure expenditure contributing to gender equality through a system of scores based on the objectives pursued by activities supported under Union programmes. Further guidance should be provided by the Commission to ensure the consistent application of that principle including the establishment of minimum criteria linking the attribution of gender equality scores to gender equality-specific objectives, and to the systematic use of ex ante and ex post gender impact assessments and gender analysis. This Regulation should also ensure improved collection, reporting and evaluation of comparable gender-disaggregated data and should allow to identify not only the beneficiaries of the funds, but also gender equality impact of the programmes and actions and the overall funds dedicated to gender equality. For activities whose objectives are not gender-specific, compliance with the gender equality principle may be ensured through an assessment confirming that the activity is gender-neutral or, at a minimum, does not risk producing adverse effects on equality between women and men. Ensuring equal opportunities for women and men is essential for a well-functioning labour market, economic resilience and sustainable growth. The Union's budget should contribute to supporting women’s participation in the workforce, skills development and entrepreneurship.

Amendment(8a) In the framework of the Interinstitutional Agreement between the European Parliament, the Council of the European Union and the European Commission on budgetary discipline, on cooperation in budgetary matters and on sound financial management, as well as on new own resources, including a roadmap towards the introduction of new own resources, the Commission developed a methodology to track gender-related expenditure in the Union budget, which has been applied since 2021. This methodology deals with the budgetary contribution to gender equality of each programme, as well as the overall budgetary contribution to gender equality. The data shows that only 12 % of the Union budget (EUR 158.4 billion) between 2021 and 2024 supported gender equality.

Text proposed by the Commission(10) The Charter of Fundamental Rights of the European Union prohibits discrimination on the grounds of disability and guarantees the right of persons with disabilities to independence, social and occupational integration, and participation in community life. Moreover, the Union is party to the UN Convention on the Rights of Persons with Disabilities, which requires that the protection and promotion of the human rights of persons with disabilities is taken into account in all policies and programmes. The budget should therefore ensure the effective promotion of the rights of persons with disabilities and their equal opportunities as well as aim to remove any inequalities, where feasible and appropriate. In particular, programmes and activities should aim to ensure accessibility for persons with disabilities in all infrastructures, products and services, including in the built environment, in transport and in information and communication also concerning information and communication technologies. They should also aim to support independent living and promote the transition from residential or institutional care to family and community-based services and support.

The budget should therefore ensure the effective promotion of the rights of persons with disabilities and their equal opportunities as well as aim to remove any inequalities such as those resulting from multiple discriminations, intersectional discrimination, for example discrimination based on gender and disabilities, and forms of segregation such as 'in the labour market, public and political life', where applicable. In particular, programmes and activities should aim to ensure accessibility for persons with disabilities in all infrastructures, products and services, including in the built environment, in transport and in information and communication also concerning information and communication technologies, taking into account the different situations and needs of women and girls in all their diversity, including women and girls with disabilities, migrant women, racialised women, older women, young women, LGBTIQ+ persons, single mothers and women at risk of poverty or social exclusion, in particular those living in rural, remote, depopulating and border regions. They should also aim to support independent living and promote the transition from residential or institutional care to family and community-based services and support. This intersectional approach should be duly taken into account in budget expenditure tracking, in monitoring and in evaluation, in order to prevent Union spending from maintaining or exacerbating existing inequalities. In a context of increasing anti-gender reaction, disinformation campaigns and attacks against women’s rights organisations and LGBTIQ+ organisations, Union funding should support civil society actors defending gender equality, women’s rights and fundamental rights. Performance indicators should measure the extent to which Union programmes enhance the capacity, sustainability and safety of those organisations. Union funding should contribute to ensuring effective access to sexual and reproductive health and rights, including access to age-appropriate comprehensive relationship education, family planning, modern contraception, maternal healthcare, fertility services and safe and legal abortion in accordance with Union values and fundamental rights. Budget expenditure tracking and performance indicators should therefore make it possible to assess whether Union programmes contribute to reducing inequalities in access to such services.

In the same vein, the system does not establish or prejudge what will or will not be financed from the budget. EIGE shall support the Commission in the implementation of gender mainstreaming in the MFF, providing methodological support and capacity building for EU institutions and Member States, and promoting the sharing and adoption of best practices. The Commission shall ensure adequate financing of EIGE to perform its role to its full extent. It shall be ensured that no funding is allocated to beneficiaries and organisations whose objectives, actions or programmes undermine gender equality, the values of the European Union and the rights deriving from Articles 2 and 3 TEU and which aim to reverse advances in women’s rights, or weaken fundamental rights as set out in Articles 8 and 23 of the Charter.
