Justification

Following the explanatory memorandum accompanying the Proposal, the Commission appropriately sought to rely on the legislative procedure referred to in Article 43 TFEU. The proposed legal basis however only refers to Article 43 TFEU as a whole. Having regard to the requirement of the explicit identification of the legal basis of EU legislation as specifically as possible, a reference to paragraph 2 of Article 43 TFEU should be added, specifying the more exact legal basis referring to the ordinary legal procedure for legislation in the field of the Common Fisheries Policy.

Text proposed by the Commission(1) By letter dated 4 February 2025, France requested the Commission to be empowered to accede to the Inter-American Convention for the Protection and Conservation of Sea Turtles in order to strengthen its cooperation with the countries bordering its territories on the American continent: Guadeloupe, French Guiana, Martinique, Saint Barthélemy, Saint Martin, and Saint Pierre and Miquelon in the area of protection of marine turtle species occurring in seas adjacent to the American continents and the Caribbean.	Amendment(1) By letter dated 4 February 2025, France informed the Commission of its intention to accede to the Inter-American Convention for the Protection and Conservation of Sea Turtles in order to strengthen its cooperation with the countries bordering its territories on the American continent. Guadeloupe, French Guiana, Martinique and Saint Martin are part of the territory of the European Union. Saint Barthélemy and Saint Pierre and Miquelon do not lie within the territory or maritime areas of the European Union. All of these territories will accede to the area of protection of marine turtle species occurring in seas adjacent to the American continents and the Caribbean.

Text proposed by the Commission(2) The matters covered by the Inter-American Convention for the Protection and Conservation of Sea Turtles fall within the Union's exclusive competence. Therefore, Member States may accede to this Convention only if empowered by the Union in accordance with Article 2(1) of the Treaty on the Functioning of the European Union.	Amendment(2) The matters covered by the Inter-American Convention for the Protection and Conservation of Sea Turtles do not fall within the Union's exclusive competence. Foreign affairs fall within the competence of the Member States, while environmental policy is a competence that is shared between the Union and the Member States. Therefore, Member States may accede to this Convention without being empowered to do so by the Union.

Therefore, it is appropriate that the European Union empowers France to accede to this Convention.	Amendment(3) The Inter-American Convention for the Protection and Conservation of Sea Turtles is in line with the policy of France and of the Union to protect marine biological resources in Member State and Union waters, and in this case, in particular, to undertake measures to protect sea turtles, and it is open for accession to States in the Americas. Therefore, it is not necessary for the European Union to empower France to accede to this Convention.
