Article 1b
Definitions to be provided in the NRP Plans
Member States shall establish in their NRP Plans, as referred to in Title III of the NRP Regulation, the definitions of ‘agricultural activity’, ‘agricultural area’, ‘eligible hectare’, and ‘young farmer’ in accordance with objective and non-discriminatory criteria and the principle of proportionality,
1. "Agricultural activity" shall be determined in such a way that it allows to contribute to the provision of private and public goods through one or both of the following activities:
(i) production of agricultural products, which consists of all activities aimed at obtaining those products; where agricultural products means products listed in Annex I to the TFEU, with the exception of fishery products, as well as cotton and short rotation coppice;
(ii) maintenance of agricultural areas, which consists of the activities aiming at keeping the land in a state suitable for grazing or cultivation, without preparatory action going beyond the use of usual agricultural methods and machinery;
2. "Agricultural area" shall be defined in such a way as to comprise only of;
(i) lands that are used for agricultural activities including when they form agroforestry systems and paludiculture systems;
(ii) lands that provide and enhance biodiversity including areas that contain trees or shrubs that can be grazed and form part of established local practices or areas where grasses and other herbaceous forage are traditionally not predominant that contribute to the environmental and climate-related CAP specific objectives, including when they form HNV landscapes;
3. ‘Eligible hectare’ shall be defined in such a way as to comprise only areas which are at the farmers’ disposal and which comprise:
(i) agricultural areas on which an agricultural activity is performed under the farmer’s control including lands that are under management commitments to comply with requirements and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives;; if non-agricultural activities are also performed on these areas, the agricultural activity shall be predominant; where duly justified for environmental, biodiversity and climate-related reasons, Member States may decide that eligible hectares also include certain areas used for agricultural activities only every second year:
(ii) areas for which support is provided under Article 35(1) points (a) and (g) [degressive income support, small farmers] of the NRPRegulation, or under the basic income support for sustainability under Title III, Chapter II, Section 2, Subsection 2, [BISS [all incl. entitlements], small farmers scheme], of Regulation (EU) 2021/2115, where agricultural activity is not performed by an individual farmer due to commitments and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives;
(iii) Member States may decide to include in the notion of ‘eligible hectare’ landscape features, not covered by the commitments and schemes referred to in point (ii), provided that these landscape features do not significantly hamper the performance of agricultural activity and are not predominant on the agricultural parcel;
4. The definition of ‘young farmer’ for the purposed of establishing eligibility for young farmers support under this regulation shall be defined in such a way as to fulfil at least the following conditions:
(i) an upper age limit of 40 years;
(ii) being ‘head of the holding’ at the time of the application for supports, the period of time as head of the holding in advance of making the application shall not affect eligibility for the scheme;
Where a farmer is deemed to fall within the definition of ‘young farmer’ at the moment offirst access to support, that status shall be maintained for the full duration of the period of eligibility established under the relevant support scheme, irrespective of the farmer subsequently exceeding the upper age limit.

Justification

It is important that these key definitions encompass all farmers farming all land types across the EU. The reality of the agricultural sector, is that part-time, family-run, and dual-income farming models are common. Such farmers often play an important role in maintaining agricultural land in productive use, sustaining rural communities, and contributing to local food production. Farmers who meet the minimum activity and eligibility requirements, should be treated equally regardless of whether agriculture constitutes their principal economic activity.

Article 1b
Definitions under the NRP Plans
1. Member States shall establish in their NRP Plans, pursuant to Title III of the NRP Regulation, the definitions of ‘agricultural activity’, ‘agricultural area’, ‘eligible hectare’ and ‘young farmer’ on the basis of objective and non-discriminatory criteria and in accordance with the principle of proportionality.
2.‘Agricultural activity’ shall be determined through one or all of the following activities:
(a) production of agricultural products, which consists of all activities aimed at obtaining those products, where agricultural products means products listed in Annex I to the TFEU, with the exception of fishery products, as well as cotton and short rotation coppice;
(b) maintenance of agricultural areas, which consists of the activities aimed at keeping the land in a state suitable for grazing or cultivation; where duly justified for animal welfare or environmental reasons, extensive grazing of an agricultural area that does not result in an increase of agricultural production for the farmers concerned may also be considered ‘maintenance’;
(c) (new) agricultural activity may be supplemented by other activities such as the production of renewable energy and biofuels, provided that they are supplementary in nature.
3. ‘Agricultural area’ shall be defined in such a way as to comprise only areas used for agricultural activities, including areas that form part of agroforestry systems and for supplementary use for the purposes of energy production, in particular biofuels and renewable energy, including by means of agri-photovoltaic systems, provided that this use does not undermine or replace the performance of agricultural activity.
4. ‘Eligible hectare’ shall be defined in such a way as to comprise only areas which are at the farmers’ disposal and which comprise:
(a) agricultural areas on which an agricultural activity is carried out where the farmer retains control of management, benefits and financial risks. If non-agricultural activities are also performed on these areas, the agricultural activity shall be predominant. Agricultural production may be supplemented with the use of intermediate or secondary crops which, in addition to fulfilling an agricultural role, may be used to produce biofuels, provided that this use is supplementary in nature and does not undermine the performance of agricultural activity or modify the predominantly agricultural nature of the area in question;
(b) areas for which support is provided under Article 5(1), points (a) and (g), [degressive income support, small farmers] of the aforementioned Regulation, or under the basic income support for sustainability under Title III, Chapter II, Section 2, Subsection 2 [BISS [all incl. entitlements], small farmers scheme] of Regulation (EU) 2021/2115, where agricultural activity is not performed due to commitments and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives;
(c) Member States may decide to include in the notion of ‘eligible hectare’ landscape features not covered by the commitments and schemes referred to in point (ii) provided that those features do not significantly hamper the performance of agricultural activity and are not predominant on the agricultural parcel.
5. ‘Young farmer’ shall be defined in such a way as to fulfil at least the following conditions:
(a) an upper age limit of between 35 and 40 years;
(b) being ‘head of the holding’.
Where a farmer is deemed to fall within the definition of ‘young farmer’ at the moment of first access to support, that status shall be maintained for the full duration of the period of eligibility established under the relevant support scheme, irrespective of the farmer subsequently exceeding the upper age limit.

2. ‘Agricultural activity’ shall be determined through one or both of the following activities: (a) production of agricultural products, which consists of all activities aimed at obtaining those products; where agricultural products mean products listed in Annex I to the TFEU, with the exception of fishery products, as well as cotton and short rotation coppice; (b) maintenance of agricultural areas, which consists of the activities aiming at keeping the land in a state suitable for grazing or cultivation; where duly justified for animal welfare or environmental reasons, extensive grazing of an agricultural area that does not result in an increase of agricultural production for the farmers concerned may also be considered ‘maintenance’.
3. ‘Agricultural area’ shall be determined in such a way as to comprise only land which is used for agricultural activities, including when it forms agroforestry systems.
4.‘Eligible hectare’ shall be determined in such a way as to comprise only areas which are at the farmers’ disposal and which comprise:
(a) agricultural areas on which an agricultural activity is performed under the farmer’s control in terms of management, benefits and financial risks. If non-agricultural activities are also performed on these areas, the agricultural activity shall be predominant;
(b) areas for which support was provided under interventions referred to in Article 5(1) points (a) and (g) [degressive income support, small farmers] of this Regulation, or gave a right to payments under the basic income support for sustainability under Title III, Chapter II, Section 2, Subsection 2, [BISS [all incl. entitlements], small farmers scheme], of Regulation (EU) 2021/2115, where agricultural activity is not performed due to commitments and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives;
(c) Member States may decide to include in the notion of ‘eligible hectare’ landscape features, not covered by the commitments and schemes referred to in point (b), provided that these landscape features do not significantly hamper the performance of agricultural activity and are not predominant on the agricultural parcel. Areas used for the production of hemp varieties with Tetrahydrocannabinol (THC) content exceeding 0,3% shall not be eligible for hectares under this Regulation.
5. ‘Young farmer’ shall be determined in such a way as to comprise natural or legal persons meeting the definition of ‘farmer’ referred to in Article 2a(1) who fulfil at least the following conditions:
(a) an upper age limit set between 35 years and 40 years;
(b) being ‘head of the holding’. Where a farmer is deemed to fall within the definition of ‘young farmer’ at the moment of first access to support, that status shall be maintained for the full duration of the period of eligibility established under the relevant support scheme, irrespective of the farmer subsequently exceeding the upper age limit. Where a young farmer is setting up the agricultural activity according to Article 14, conditions related to meeting the definition of ‘farmer’ referred to in Article 2a (1) and being ‘head of the holding’ may be fulfilled as a result of the setting-up proces.
6.‘New farmer’ shall be determined in such a way as to refer to a farmer other than a young farmer and who is head of the holding for the first time.

Justification

This proposal is important in light of the planned approach to establishing interventions for young farmers, which should be maintained and further supported. In particular, it reflects solutions aimed at enabling support for young persons who are not yet carrying out agricultural activity at the moment of applying, but who intend to commence such activity within a specified period after the support has been granted. This flexibility is essential to facilitate generational renewal and to ensure that young people can effectively enter the agricultural sector.

2. The definition of ‘agricultural activity’ shall be determined through one or both of the following activities:
(a) production of agricultural products, which consists of all activities aimed at obtaining those products; where agricultural products means products listed in Annex I to the TFEU, with the exception of fishery products, as well as cotton and short rotation coppice and products produced by paludiculture;

(b) areas for which support is provided under Article 5 points (a) and (g) [income support, small farmers] of this Regulation, or under the basic income support for sustainability under Title III, Chapter II, Section 2, Subsection 2, [BISS [all incl. entitlements], small farmers scheme], of Regulation (EU) 2021/2115, where agricultural activity is not performed due to commitments and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives. Member States may decide to include in the notion of ‘eligible hectare’ landscape features, and other elements, such as agrivoltaics not covered by the commitments and schemes referred to in point (b), provided that those landscape features and other elements do not significantly hamper the performance of agricultural activity and are not predominant on the agricultural parcel
5. The definition of ‘young farmer’ shall be defined in such a way as to fulfil at least the following conditions:
(a) the farmer is 40 years old or younger;
(b) the farmer is the ‘head of the holding, meaning that the young farmer exercises effective control over the holding; where the holding is operated by a legal person, this condition shall be fulfilled where business decisions cannot be taken.
(c) in case of a cooperative farm, as a legal cooperative, a comparable legal entity or an association of natural persons or legal entities, an individual member of that cooperative farm shall also qualify as a young farmer, provided that the members participate on an equal footing in the holding.
Where a farmer is deemed to fall within the definition of ‘young farmer’ at the moment of first access to support, that status shall be maintained for the full duration of the period of eligibility established under the relevant support scheme, irrespective of the farmer subsequently exceeding the upper age limit.

or (ii) a natural person or small legal person, whose principal activity is not agriculture, but who is engaged in at least a minimum level of agricultural activity, as defined by Member States, thereby contributing to the safeguarding of food security, land and territory and to the provision of ecosystem services for the benefit of rural areas and communities; where the farmer operates through a legal person, that legal person shall be deemed to be a farmer only where the majority of the share-capital is held by farmers as natural persons working in the holding;
(2) An ‘active farmer’ shall be determined in such a way as to comprise primarily farmers who exercise an agricultural activity on their holding and actively contribute to the safeguarding of food security, land and territory and to the provision of ecosystem services for the benefit of rural areas and communities; support shall not be precluded to pluri-active or part-time farmers. When determining who is an ‘active farmer’ , Member States shall apply objective and non-discriminatory criteria, including through a negative list disqualifying a farmer from being considered active farmer. Small farmers, whose principal activity is not agricultural activity, but who are engaged in at least a minimum level of agricultural activity, as set out by Member States, shall be considered active farmers as well;
(3) ‘operation’ means a payment granted to farmers under area- and animal-based CAP income support interventions referred to in Article 5(1), points (a) to (g), (o) and (p) of that Regulation;
(4) ‘new farmer’ shall be determined in such a way as to refer to a farmer other than a young farmer and who is head of the holding for the first time;
(5) ‘organic farming’ means organic production system certified in accordance with Regulation (EU) 2018/848 of the European Parliament and of the Council;
(6) ‘holding’ means all the units used for agricultural activities and managed by a farmer and situated within the territory of the same Member State, within the territorial scope of the Treaties, as defined in Article 52 TEU in conjunction with Articles 349 and 355 TFEU;
(7) ‘Agricultural Knowledge and Information system’ or ‘AKIS’ means the combined organisation and knowledge flows between persons, organisations and institutions who use and produce knowledge and innovations for agriculture and interrelated fields referred to in Article 20 of this regulation;
(8) ‘the smaller Aegean islands’ means any islands in the Aegean Sea except the islands of Crete and Evia.

(c) Member States shall include in the notion of ‘eligible hectare’ landscape features , not covered by the commitments and schemes referred to in point (ii), which contribute to the wider agricultural production system or form an integral agronomic or cultural part of it, contribute to long-term productivity or to the performance of agricultural activity, or protect the factors of production. For the purposes of allowing extensive grazing systems, this may extend to common land where appropriate to cover transhumance, and include wooded, shrub-rich and other heterogeneous pasture areas where livestock grazing is effectively carried out, to cover silvopastoral systems and other types of agroforestry systems, and paludiculture.
(4a new) Member states shall define 'extensive livestock systems' as grazing systems that include traditional grazing systems such as sylvo-pastoralism, transhumance of not only bovines, sheep and goats, but also buffalo, bison, cervids including reindeer. It may also be carried out on common or shared land and may be supported by coupled income support per head of animal, and may be included under the agri-environmental actions under article 10 of this regulation. MS shall define it as a grazing system below 2 LSU/ha that can produce at least 70% of its own feed or source it locally.

Small farmers whose principal activity is not agriculture but who are engaged in at least a minimum level of agricultural activity, as set out by Member States, shall also be considered active farmers.
(a) A natural person may only be recognised as an active farmer in relation to a single legal entity;
(b) If a stake is held by a legal person, the natural persons actively carrying out the agricultural work must hold at least 51 % of its capital and 65 % of its voting rights;
(c) An individual shall not be considered an active farmer if his or her annual non-agricultural income, including income from commercial activities carried out on the holding, exceeds by a factor of three the national median wage, in particular those who own companies or other undertakings where the real beneficiaries of the support are not farmers.

Member States shall include a negative list disqualifying certain categories of beneficiaries from being considered active farmers. The negative list referred to in the preceding subparagraph shall include at a minimum the following categories, which Member States shall apply in all cases:
(a) legal persons or groups of legal persons whose principal business object, as registered in the national commercial register, is financial investment, real estate management or the operation of infrastructure not primarily agricultural in nature, including airports, railways, waterworks and sports facilities;
(b) public authorities and bodies governed by public law, where land holdings are not managed as an active agricultural holding under direct management responsibility;
(c) natural or legal persons who receive income support from this Regulation exclusively by virtue of land ownership, without taking financial and organisational responsibility for the management of the agricultural holding.
Member States shall establish and maintain a national register of active farmers and shall publish the criteria applied, including the full content of their negative list.

Justification

The amendment strengthens the active farmer definition by making the negative list mandatory. Previous CAP reforms have demonstrated that leaving the exclusion of illegitimate beneficiaries entirely to Member State discretion produces systematic divergence: in some Member States, investment funds, real estate companies, public infrastructure operators and other non-farming entities continue to receive CAP income support, diverting funds from genuine farmers and contributing to land price inflation that directly harms young farmers entering the sector. A mandatory minimum negative list at EU level, based on clearly identifiable categories addresses the most clear-cut cases of misuse without encroaching on Member State competence for agricultural policy design.Former NRP Article 4 - Amendment consists of the introduction of negative lists disqualifying certain categories of beneficiaries from being considered active farmers.

(a) the prioritisation of local agricultural production as a means of feeding the population and the prioritisation of access to land, water, seeds and credit; this calls for agrarian reforms, measures to combat GMOs with a view to providing free access to seeds, and measures to ensure that water remains a public good which is to be distributed in a sustainable manner;
(b) the right of farmers to produce food and the right of consumers to take decisions regarding the food they wish to consume, who produces it and how;
(c) the right of nations to protect themselves against agricultural and food imports priced below the cost of production or involving unfair competition practices. In order to do so, nations or unions must have the right to tax imports with excessively low prices, commit to sustainable agricultural production and control production on the internal market in order to avoid structural surpluses;
(d) the involvement of local populations in agricultural policy choices;
(e) the recognition of the rights of farmers, who play a key role in agricultural production and food.

The Commission's national recommendations must remain non-binding, offering Member States broad strategic guidance on overarching objectives such as food sovereignty, fair incomes, and the competitiveness, resilience and development of agriculture and rural areas, rather than prescriptive requirements for National Plans. It is necessary to have prior knowledge of the situation of each Member State in order for the Commission to issue tailored national recommendations for each Member State. In order to properly understand the actual situation, consultation with recognised bodies in the field is required, so as to accurately identify the needs and subsequently the ways to address them. Because these neighboring third countries frequently utilize chemical active substances and plant protection products that are prohibited within the Union due to strict environmental and public health standards, frontline Member States face severe asymmetrical phytosanitary pressures, as their farmers must combat these migratory pests without access to the same chemical tools, resulting in higher crop losses and escalated management costs.

This amendment highlights a double vulnerability specific to the Union's external borders, particularly on the eastern flank. Farmers in these regions do not just suffer from the macroeconomic distortions of adjacent conflict zones; they also operate as a phytosanitary shield for the entire internal market. Because neighboring non-EU countries are not bound by the same strict chemical prohibitions regarding active substances, cross-border pests thrive and migrate into the EU. This forces frontline EU farmers to combat aggressive pest pressures under a severe competitive disadvantage, using only EU-approved, lower-impact substances. Formally recognizing this specific structural vulnerability allows Member States to design targeted, heavily compensated protective and environmental actions within their NRP Plans to buffer their agricultural sectors against cross-border biological and regulatory imbalances.

(i) suitability, completeness and estimated efficacy of the CAP-relevant parts of the plans and spending, in particular to ensure coherence with other Union policies, and budgetary efficiency, avoiding the need of double spending, or fixing damage allowed in one policy field by expenditure in another; and
(ii) the chapter dedicated to the CAP in the NRP plan is able to meet the needs and challenges of the Member State as outlined in article 21 and article 22 [NRP reg], in particular paragraph 2, subparagraph 2, point (a) regarding consistency with Nature restoration plans under Regulation (EU) 2024/1991 and National Energy and Climate Plans under Regulation (EU) 2018/1999;
(iii) ensure that relevant spending and budget allocation parameters are respected, in particular climate and biodiversity spending in line with article 4 of this regulation and Annex III [CPF reg.];
(iiii) ensure that the rights, freedoms and principles set out in the Charter of Fundamental Rights and the principles of the rule of law are respected, in line with article 8 and 9 of NRP regulation;
(iv) ensure consistency and continuity of Member States’ achievements so far with respect to green architecture, and that the no backsliding principle is maintained, namely:
(a) at least the equivalent actions for climate and environment, in Article 10, exist in the new CAP plans within the NRP plans, with the at least same estimated take-up as the former ecoschemes and AECMs from the last programming period, basing this estimation of take-up also on co-financing rates.
(b) Member States' definition of protective practices in accordance with Article 3 allows Farm Stewardship to:
- offer a robust baseline for basic practice, above which additional CAP incentive payments can be leveraged, to be fair and equivalent between MS and regions;
- ensure protective practices are satisfactory as basic good farming practices carried out by all beneficiairies to meet the challenges expected during the programming period and the needs identified;
- respect the level playing field in the single market, between and within Member States;
- are sufficient to ensure no significant harm.
The Commission shall clearly identify potential deficiencies with respect to this article and include them in its recommendations for remedial action.

In their CAP plans, Member States shall also lay down the following definitions:
1. ‘agricultural activity’ shall be determined through one or both of the following activities:
(I) production of agricultural products, which consists of all activities aimed at obtaining those products; where agricultural products means products listed in Annex I to the TFEU, with the exception of fishery products, as well as cotton and short rotation coppice;
(II) maintenance of agricultural areas, which consists of the activities aiming at keeping the land in a state suitable for grazing or cultivation; where duly justified for animal welfare or environmental reasons, extensive grazing of an agricultural area that does not result in an increase of agricultural production for the farmers concerned may also be considered ‘maintenance’.
2. ‘agricultural area’ shall be defined in such a way as to comprise only land which is used for agricultural activities, including when it forms agroforestry systems.
3. ‘eligible hectare’ shall be defined in such a way as to comprise only areas which are at the farmers’ disposal and which comprise:
(I) agricultural areas on which an agricultural activity is performed. If non-agricultural activities are also performed on these areas, the agricultural activity shall be predominant;
(II) areas for which support is provided under Article 5(1) points (a) and (g) [degressive income support, small farmers] of this Regulation, or under the basic income support for sustainability under Title III, Chapter II, Section 2, Subsection 2, [BISS [all incl. entitlements], small farmers scheme], of Regulation (EU) 2021/2115, where agricultural activity is not performed due to commitments and obligations arising from Union or national interventions or other programmes which contribute to the environmental and climate-related CAP specific objectives
(III) Member States may decide to include in the notion of ‘eligible hectare’ landscape features, not covered by the commitments and schemes referred to in point (ii), provided that these landscape features do not significantly hamper the performance of agricultural activity and are not predominant on the agricultural parcel
4. ‘young farmer’ shall be defined in such a way as to fulfil at least the following conditions:
(I) an upper age limit set between 35 years and 40 years;
(II) being ‘head of the holding’. Where a farmer is deemed to fall within the definition of ‘young farmer’ at the moment of first access to support, that status shall be maintained for the full duration of the period of eligibility established under the relevant support scheme, irrespective of the farmer subsequently exceeding the upper age limit.
5. ‘new farmer’ shall be determined in such a way as to refer to a farmer other than a young farmer and who is head of the holding for the first time.
6. ‘public expenditure’ for the purposes of the CAP, means any contribution to the financing of operations the source of which is the budget of the national, regional and local public authorities, the budget of the Union made available to the Fund, the budget of public law bodies or the budget of associations of public authorities or public law bodies;
7. ‘support rate’ for the purposes of the CAP, means the rate of public expenditure to an operation; in the context of financial instruments it refers to the gross grant equivalent of the support as defined in Article 2, point (20) of Commission Regulation (EU) No 702/2014.

(d) A description of the design of the intervention, including the eligibility conditions, limited to essential elements necessary for implementation and evaluation and for agri-environmental and climate actions referred to in Article 10 of this Regulation];
(e) a description of farming practices covered by the intervention, allowing Member State flexibility in applying relevant scientific and technical classifications, based on the Joint Research Centre classification of farming practices in accordance with paragraph 5 of Article 3 of this Regulation.
(f) in relation to the interventions in certain sectors referred to in Part II, Title I, Chapter IIa of Regulation (EU) No 1308/2013, justification for targeting the selected sectors and complementarity with other CAP interventions, and where relevant, with other measures set out in the Plan, while preserving Member States discretion in setting priorities and avoiding unnecessary duplication of justification requirements;
2. Member States shall determine the amount of support for transition actions referred to in Article 10(1), point (b), of this Regulation based on cost estimates set out in the transition plans. The support shall be limited to [EUR 200 000] per farmer per programming period of the Plan, with Member State retaining flexiility to adjust implementation in justified cases reflecting national circumstances.
Where public support granted under Article 13 of this Regulation (EU) for an investment operation does not exceed EUR 100 000 and is not subject to rules on public procurement, that support shall take the form of standard scales of unit costs, lump sums or flat rates, wherever appropiate, in order to reduce administrative burden.

Justification

It is necessary to have prior knowledge of the situation of each Member State in order for the Commission to issue tailored national recommendations for each Member State. In order to properly understand the actual situation, consultation with recognized bodies in the field is required, so as to accurately identify the needs and subsequently the ways to address them. This consultation aims to ensure transparency in the decision making process.To ensure the economic resilience and attractiveness of the agricultural sector, while strengthening intergenerational renewal by supporting young farmers` access to resources and know-how for sustainable agricultural practices and ensuring that farmers are fairly rewarded for their contributions to environmental and climate objectives, in a balanced and proportionate way that reflects the multiple roles of agriculture.To ensure a simplified, proportionate and flexible implementation framework for CAP interventions, while reducing unnecessary administrative burden for Member States and farmers, strengthening subsidiarity and allowing national and regional specificities to be fully taken into account. The amendments aim to maintain compliance with EU and international obligations while avoiding excessive prescriptiveness, duplication of reporting requirements and overly complex procedural rules.

Is proposed removing the sentence that sets a maximum support of EUR 200,000 per farmer per programming period for transition actions. This arbitrary cap is overly restrictive and could hinder the ability of farmers, particularly medium and larger enterprises, to implement necessary transition measures.

Transition actions often involve substantial investments in technology, infrastructure, or environmental improvements. Setting a fixed upper limit risks underfunding projects where actual costs exceed the cap, potentially delaying or preventing important sustainability or modernization initiatives.

By removing this limit, Member States can tailor support more effectively to the real costs of transition actions, ensuring that all farms, regardless of size, have the opportunity to adopt measures that contribute to environmental objectives, competitiveness, and long-term resilience of the agricultural sector.
