Added:(16) ‘authorised representative’ means any natural or legal persons established within the Union that have received a written mandate from a manufacturer to act on their behalf in relation to specified tasks;

Added:(17) ‘importer’ means any natural or legal persons established within the Union that place a detergent or surfactant from a third country on the Union market;

Added:(18) ‘distributor’ means any natural or legal persons in the supply chain, other than the manufacturer or the importer, that make a detergent or surfactant available on the market;

Added:(19) ‘economic operator’ means the manufacturer, the authorised representative, the importer or the distributor;

Added:(20) ‘market surveillance’ means the activities carried out and measures taken by market surveillance authorities to ensure that products comply with the requirements set out in in this Regulation and other applicable Union harmonisation legislation and to ensure protection of the public interest covered by that legislation; [Am. 36]

Added:(21) ‘market surveillance authority’ means a market surveillance authority as defined in Article 3, point 4, of Regulation (EU) 2019/1020 as responsible for organising and carrying out market surveillance in the territory of that Member State; [Am. 37]

Added:(22) ‘recall’ means a recall as defined Article 3, point 22, of Regulation (EU) 2019/1020;

Added:(23) ‘withdrawal’ means a withdrawal as defined in Article 3, point 23, of Regulation (EU) 2019/1020;

Added:(24) ‘CE marking’ means a marking by which the manufacturer indicates that the detergent is in conformity with the applicable requirements set out in Union harmonisation legislation providing for its affixing; [Am. 38]

Added:(25) ‘corrective measureaction’ means a measurean action as defined in Article 3, point 16, of Regulation (EU) 2019/1020; [Am. 39]

Added:(26) ‘release for free circulation’ means the procedure laid down in Article 201 of Regulation (EU) No 952/2013;

Added:(27) ‘data carrier’ means a linear bar code symbol, a two-dimensional symbol or other automatic identification data capture medium that can be read by a device;

Added:(28) ‘unique product identifier’ means a unique string of characters that allowsfor the identification of a product andthat also enables a web link to the product passport; [Am. 40]

Added:(29) ‘unique operator identifier’ means a unique string of characters for the identification of economic operatorsactors involved in the value chain of products; [Am. 41]

Added:(30) ‘customs authorities’ means customs authorities as defined in Article 5, point 1, of Regulation (EU) No 952/2013;

Added:(31) ‘EU Customs Single Window Certificates Exchange System’ means the system referred to in Article 4 of the Regulation (EU) 2022/2399 of the European Parliament and of the Council ;

Added:(32) ‘individual packaging’ means packaging in which the detergent or surfactant is made available on the market and which is intended to accompany the content to the place of use;

Added:(33) ‘refill’ means the operation by which thea consumer or a professional user fills a packaging with a detergent is filled in-store from a large containeroffered by a supplier in the end-users’ own package either manually or through automatic or semi-automatic equipmentcourse of a commercial activity, whether in return for payment or free of charge; [Am. 42]

Added:(34) ‘batch’ means a defined quantity of finished products that meets the following conditions:

Added:- is produced in a single manufacturing process or a series of processes during the same manufacturing cycle;

Added:- is intended to have a uniform composition when tested in accordance with the same test methods; and

Added:- is clearly defined by a type number, batch number or other element allowing its identification.

Added:(34a) ‘model’ means a group of detergents or surfactants that meet the following conditions:

Added:- they are under the responsibility of the same manufacturer;

Added:- they have the same content, in accordance with Part A of Annex V, and are manufactured using the same manufacturing processes;

Added:- they are intended to have a uniform composition when tested in accordance with the same test methods; and

Added:- they are clearly defined by a type number or other element allowing their identification. [Am. 43]

Added:(35) ‘end-user’ means any natural or legal person residing or established in the Union, to whom a detergent or surfactant has been made available either as a consumer outside of any trade, business, craft or profession or as a professional end-user in the course of its industrial or professional activities.

Added:CHAPTER II PRODUCT REQUIREMENTS

Added:Article 3 Free movement

Added:1. Detergents and surfactants may only be placed on the market if they comply with this Regulation.

Added:2. Member States shall not prohibit, restrict or impede the placing on the market of detergents or surfactants which comply with this Regulation.

Added:Article 4 Biodegradability

Added:1. Detergents and surfactants shall comply with the biodegradability requirements laid down in Annex I.

Added:2. Paragraph 1 shall not apply to surfactants that are active substances, as defined in Article 3(1), point (c), of Regulation (EU) No 528/2012, and that are used as disinfectants when they meet any of the following conditions: [Am. 44]

Added:(a) surfactants that arethey are included in the Union list of approved active substances within the meaning ofas laid down in Article 3(1), point (c),9(2) of Regulation (EU) No 528/2012 and that are used as disinfectants where they meet any of the following conditions:; [Am. 45]

Added:(i) the surfactants are included in the Union list of approved active substances as laid down in Article 9(2) of Regulation (EU) No 528/2012; [Am. 46]

Added:(ii) the surfactants are included in the review programme as set out in Commission Delegated Regulation (EU) No 1062/2014; [Am. 47]

Added:(b) surfactants that are constituents of biocidal products authorised in accordance withthey are included in the review programme as set out in Commission Delegated Regulation (EU) No 528/2012No 1062/2014; [Am. 48]

Added:(c) surfactants thatthey are constituents of biocidal products and which may be made available on the market or used in accordance with Article 89(2)55 of Regulation (EU) No 528/2012. [Am. 49]

Added:2a. By... [4 years from the entry into force of the delegated act adopted in accordance with the second subparagraph] organic ingredients of detergents other than surfactants shall be inherently biodegradable.

Added:By… [two years from the date of entry into force of this Regulation], the Commission shall adopt delegated acts in accordance with Article 27 to supplement Annex I with inherent biodegradability criteria and test methods for constituents other than surfactants.

Added:Where necessary, the Commission is empowered to adopt delegated acts in accordance with Article 27 to allow for the use of substances in detergents that do not comply with the biodegradability criteria established in accordance with Annex I.

Added:When adopting delegated acts in accordance with the second and third subparagraphs, the Commission shall take into account manufacturing practices, the availability of technically and economically feasible alternatives, the impact on small and medium-sized enterprises and the impact on health and environment. Added:2b. By... [two years from the entry into force of the delegated act adopted in accordance with the second subparagraph], water-soluble film around detergents shall be degradable.

Added:By… [18 months from the date of entry into force of this Regulation], the Commission shall adopt delegated acts in accordance with Article 27 supplementing Annex I with criteria and test methods for the degradability of water-soluble film around detergents. [Am. 51]

Added:Article 5 Detergents containing micro-organisms

Added:Detergents containing micro-organisms shall comply with the requirements laid down in Annex II.

Added:Article 6 Limitations on the content of phosphates and other phosphorus compounds

Added:Detergents listed in Annex III shall comply with the limitations on the content of phosphates and other phosphorus compounds laid down in that Annex.

Added:The first paragraph shall not apply to detergents that are industrial biocidal products within the meaning of Regulation (EU) No 528/2012 or medical devices within the meaning of Regulation (EU) No 2017/745. [Am. 52]

Added:The unintentional presence in surfactants and detergents of phosphates and other phosphorus compounds that stems from impurities of ingredients, from the manufacturing process or storage or from migration from packaging, shall be tolerated if that presence is technically unavoidable in good manufacturing practice and, notwithstanding such presence, those surfactants and detergents are safe. [Am. 53]

Added:Article 6a Animal testing

Added:1. The safety of detergents and surfactants and conformity with this Regulation shall be established by using non-animal new approach methods validated and adopted at Union level.

Added:2. Without prejudice to the general obligations pursuant to Article 1(1), the following shall be prohibited:

Added:(a) the placing on the market of detergents and surfactants where the final formulation or ingredients or combinations of ingredients have been the object of animal testing with a view to meeting the requirements of this Regulation;

Added:(b) the performance within the Union of animal testing of finished detergents and surfactants or ingredients or combinations of ingredients with a view to meeting the requirements of this Regulation.

Added:3. Paragraphs 1 and 2 shall be applicable without prejudice to relevant Union law, and shall not prevent the use of data acquired before .... [the date of entry into force of this Regulation].

Added:4. In exceptional circumstances, where concerns arise as regards the safety of a detergent ingredient, the Commission may adopt a decision granting a derogation from paragraphs 1 and 2. The Commission may act on its own initiative or on the basis of a reasoned request from an economic operator or a Member State.

Added:When the Commission acts on the basis of a reasoned request from an economic operator or a Member State, that request shall contain an evaluation of the situation and indicate the necessary measures. On that basis, the Commission may, after consulting the relevant scientific Committee, Agency or body, adopt a decision authorising the derogation.
